Dear Mr. Barker:
I have your letter of October 23 and appreciate your willing-
ness to try to have the court take the time of my availability into
consideration.
The matter is not quite so important nor so simple as that.
In general, I do not feel justified in planning trips for lectures or
other objects outside of the University interests more often than about
one per quarter. I have, therefore, been reserving the fall quarter for
this trip to New York and putting off other dates until the winter or
spring quarter.
I believe your last estimate was that the case would come up
some time between October 15 and November 15. I judge now that it is
likely to be somewhat later than these limits. Am I correct? I am not
so much concerned to avoid actual conflict (which could perhaps be done
in most cases) but to avoid having two trips fall too close together and,
therefore, being unable to make any definite plans until the approximate
date at least of your trial is set. Has the judge again set any approximate
limits?
I realize, of course, that court matters cannot be run on a
strict schedule, but when a trip of this kind is difficult to make in term
time in any case, it becomes doubly so through uncertainty as to the date
over such long periods of time. I, therefore, do not see that there is
anything that the judge can do to help except to set a definite date
and adhere to it.
