Dear Mr. Smith:
Herewith copy of letter to Mr. Emmerglick in the
above which is self e xplanatory, together with original and copy
of further bill of particulars and copy of letter from Mr. Emmer-
glick dated October 29th.
As per my telephonic telk with you this morning, I
did not know that any date had been fixed for the final hearing
of the equity suit although you seem to think it was November
26th or November 29th. May I kindly ask you to check this as
we will have to notify the Radium Company immediately so that
they may arrange for their out of town witnesses.
The enclosed further bill of particulars is given b y
Mr. Emmerglick in accordance with an order made by Judge Fake
of December 19, 1933 requiring Mr. Emmerglick to give us any
additional information he might obtain as to the personnel of
our company chargeable with legal fraud, which additional par-
ticulars had to be served at least two days before the hearing.
However, I do not think there is anything in the further par
ticulars served that we do not already know. I am, however, send-
ing my only copy of this further bill of particulars to Mr. Lee
with the request that he return it to me after he has made a
copy.
