Dear Mr. Barker: Herewith copy of my letter to Mr. Emmerglick in the above which is self explanatory. I spoke to Mr. Gray and Mr. Kelly of the Globe on the 19th inst. and they are still waiting for a decision by Mr. Gallentine and Mr. A. Duncan Reid, President of their company as to what their position will be. Apparantly they are willing to assist in the defense of the case. As soon as I receive definite work I shall advise you. You will note from my letter to Mr. Emmerglick that as a result of my talk with him he is desirous of having the pleadings filed and the case put at issue so that in the event that Judge Forman's decision is favorable to him, he can proceed without delay. In a few days I will therefore demand particulars in each case and serve them. However, I am trying to hold up the medical preparation until such time as we have Judge Forman's decision. Mr. Emmerglick stated and I was of the same thought, that we would have Judge Forman's decision weeks ago. Apparently he has been pressed with other matters and that is the reason why he has not filed his opinion. In view of the fact that Mr. Emmerglick is desirous of putting these cases at issue and on the trial calendar, I think it would be wise for us to have a conference at your convenience for the purpose of determining just what the preparations should consist of. We will probably want to make a special investigation of Anita Burricelli. We will also have to check on the medical history in both cases, the cause of death of the Weber girl, thether there was any autopsy, etc. In other words, we vill have to go through the usual routine and not let it go until the last minute.
