"TAR," NICOTINE AND OTHER CONSTITUENT 2 DISCLOSURE TO THE PUBLIC. 3 Section 4 of the Federal Cigarette Labeling and Advertising Act is 4 amended by inserting the following paragraph at the end of subsection (a): 5 "(4)(A) The Secretary of Health and Human Services shall 6 by regulation, [by date], pursuant to a rulemaking under section 7 553 of title 5 of the United States Code, determine whether 8 cigarette manufacturers shall be required to include in the area of 9 each cigarette advertisement specified by paragraph (3) of 10 subsection (b) of this section, or on the package label, or both, 11 the 'tar' and nicotine yields of the advertised or packaged brand. 12 Any such disclosure shall be in accordance with the methodology 13 established under section 234 of the Tobacco Compensation and 14 Regulation Act of 1997 and shall be based on a finding that such 15 disclosure would benefit the public health. If the Secretary 16 determines that 'tar' and nicotine yield disclosures are required 17 in advertisements, such disclosures shall conform to the type size 18 requirements of paragraph (3) of subsection (b) of this section. 19 [type size for packs] 20 "(B) Prior to the effective date of regulations 21 promulgated pursuant to subparagraph (A) of this paragraph.
