C:\WPDOCS\08218001\ACT\BILL.3 September 30, 1997 (10:57am) DISCUSSION DRAFT 5 1 proportions that results in new generations of tobacco- 2 dependent children and adults. 3 (2) There is compelling evidence that the use of 4 tobacco products is a significant cause of a variety of diseases 5 and their various health effects. 6 (3) The Government has a significant interest in 7 protecting the health, safety and welfare of its citizens from 8 tobacco-related diseases and ill-health conditions. 9 (4) In order to deter and reduce sales of tobacco 10 products to the Nation's children, there must be mandatory 11 price increases for tobacco products. 12 (5) Various civil actions brought by State attorneys 13 general, private classes of individuals, cities, counties, the 14 Commonwealth of Puerto Rico, and third-party payors to 15 recover damages relating to tobacco-related diseases, 16 conditions and products are pending throughout the United 17 States. These plaintiffs have devoted considerable resources 18 to theses actions, which have resulted in a singular settlement 19 agreement with the tobacco industry as reflected in this Act. 20 (6) The unique position occupied by tobacco in the 21 history and economy of the United States, the magnitude of 22 the actual and potential tobacco-related litigation, the need to 23 avoid the cost, expense, uncertainty, and inconsistency 24 associated with such protracted litigation, the need to limit the 25 sale, distribution and marketing of tobacco products to persons 26 of legal age, and the need to educate the public (especially
