Effect on Existing Settlements.
1) Applicability. -- This subsection shall apply to any State that, prior to May 17,
1998, entered into an agreement with a participating tobacco product manufacturer to settle a
civil action involving a tobacco claim, if such agreement contained express provisions by which
the agreement could be superseded by federal legislation.
2) If a State to which this subsection applies determines, within 30 days of this
Act, that the legislation supersedes its agreement with said participating tobacco product
manufacturer, said state shall so certify to the Secretary of the Treasury.
3) If a State to which this subsection applies does not make such certification to
the Secretary of the Treasury, such State shall not be eligible to receive funds from the trust
fund in Title IV.
