STATEMENT BY THE PRESS SECRETARY
Reinforcement and Realignments in Somalia
The two Marine Expeditionary Units that the President ordered to
Somalia have arrived off its coast. They include 3600 Marines,
helicopters, and armored vehicles. Also included in each group
is a Special Operations capability.
With this force present, the President has approved the
recommendation of the Secretary of Defense that U.S. Army Special
Operations Command elements (Rangers) be returned to the United
States within the next few days.
This rotation of forces is part of the overall reinforcement that
the President ordered to insure that U.S. forces in Somalia are
fully protected. The reinforcement has also included the
introduction of over 2500 U.S. Army personnel and their armored
vehicles, and the aircraft carrier Abraham Lincoln.

Subject: Contracting of Logistics functions in Somalia
1. Purpose. To update the DJS on the status of UN and USG
contracting in Somalia.
2. Key Points
UN Contracting:
As stated in a 12 March 93 SYG request to the US/UN, the
logistics capability provided by the US military was requested to
remain in place until other member nations or UN civilian
contractors could replace the US logistics force structure. USG
and UN high level demarches failed to produce logistics
commitments from other member states to replace this force
structure.
Discussions have been held and are continuing between US
and UN personnel regarding the contracting of these US military
logistics functions. To date, two contracts (food and fuel) have
been discussed, however, neither is close to implementation. The
food contract has recently undergone UN legal review and will
require substantial revision as a result. The UN is hesitant to
further pursue the fuel contract and any new contracts for the
following reasons:
The UN is financially constrained at the present time
and contracting is an expensive option.
The security situation has made contracting cost
prohibitive.
The UN is hesitant to contract and thereby release US
logistics structure until the UN resolution for the whole country
has been achieved. In fact, prior to the President's withdrawal
announcement, the UN was poised to ask for additional US logistics
structure to help fulfill the mandate.
Inability of the UN to pay a civilian contractor will
result in the contractor ceasing to perform the logistics
function. Inability of the UN to pay the USG will not necessarily
cause the logistics function to cease.
The UN HQ and in-country staffs are undermanned to
accommodate the volume of workload for the contracting effort.
Finally, continued US involvement with military force
structure enhances the chance of continued participation of other
national contingents in UNOSOM.
In order to assist the UN with logistics and contract
planning in general, the USG has provided nine subject matter
experts to UN HQ for a period of 60-75 days to facilitate this
process for the future.
USG Contracting:
J4 was tasked to develop the following option: USG
expands the existing LOGCAP contract with Brown & Root to assume
some or all US logistics functions. This contract expansion would
be tailored to assume those logistics functions not covered by
existing UN contracts or logistics capabilities that may be
provided by other UNOSOM contributing countries. This option
should allow US logistics personnel strength to reduce to
approximately 1400 NLT 31 December 93 and to 0 NLT 31 March 94.
Based on informal discussions with Brown & Root, they
can assume the responsibility for all logistics functions within
approximately 6 weeks of authorization. Estimated costs are
approximately $20-25 million for start up costs and approximately
$12-15 million for monthly operation costs. Total estimated cost
for a 13 month contract (Nov 93 to Dec 94) is approximately $220
million. In order to meet the established timeframes, the drop
dead date for turning on the contractor is NLT 15 November 93.
Several problems are associated with this option:
USG Equipment: In order to meet the Presidential
drawdown timeframes, the USG will be required to leave most of
it's present logistics equipment in Somalia for use by the
contractor. The actual type/quantity of equipment must be worked
out between the contractor and the USG. This equipment would be
provided to the contractor as Government Furnished Equipment (GFE)
and at the conclusion of the contract, the equipment would be
returned to the USG.
Contractor Security: Brown & Root does not provide
its own security. The present contract that expires 6 Dec 93,
requires that the USG provide this security. Additionally, the
present contract is being modified to read "The Government will
provide necessary security for Contractor personnel throughout the
Theater of Operations (TO). This includes security at the
contractor's work sites and living/messing areas, movement
throughout the TO and ingress and egress to the TO as deemed
appropriate by the in theater Contracting Officer's
Representative.' With a political reconciliation and cessation of
violence, an off shore QRF may be able to provide this security.
With the resumption of violence now or after 31 Mar 94 (US
withdrawal), the contract would require security by possibly US
forces or other competent, well equipped and well trained forces.
Terms of Reference (TOR) A TOR was signed on 29
April 93 between General Hoar and LTG Bir, UNOSOM Force
Commander. The purpose of this TOR was to formalize guidance for
the staffing, organization and operation of US Forces Somalia.
Specifically, the US logistics support to be provided to UNOSOM
was spelled out in this document. On 4 May 93, Mr. Kofi Annan, UN
Under Secretary for Peace Keeping, forwarded a letter to
Ambassador Albright acknowledging receipt of the TOR and suggested
that established UN procedures (MOA) be used to govern this
relationship. The TOR was not modified to address Mr. Annan's
concerns. As a result, HQ UN does not formally recognize the TOR
as a binding document for tasking the Logistics Support Command.
Hence, the so called "mission creep" or those items not covered in
the TOR have been tasked to the Logistics Command. UN position is
that if it is a logistics mission and we give the USG a Letter of
Assist (LOA), the Logistics Command should perform the mission.
This has created problems to date and will continue once these
logistics functions are contracted.
Costs: The informal cost estimates provided by the
contractor are just that, informal. Until a scope of work can be
provided to the contractor for actual costing of the functions, an
actual contract price cannot be determined. Based on J4 request,
CINCCENT J4/7 has tasked the Logistics Command to develop a scope
of work to be provided to the contractor once the legal authority
and funding are obtained.
Legal Authority/Funding: Presently, there is no
legal authority or funding to proceed with this option. On 9
October 93, legal representatives from the interagency met to
discuss legal issues raised by the President's Somalia exit
strategy. It was determined that DOD has limited legal authority
that would allow the USG to provide direct assistance to the UN on
a non-reimbursable basis. One such authority, Section 7 of the UN
Participation Act, is not available as it is limited to support of
operations conducted under Chapter VI of the UN Charter. Another
possible option is 10 U.S.C. 403, which authorizes DOD to provide
non-reimbursable assistance to the UN. This authority, however,
contained a "sunset" provision and expired on 30 September 93. On
10 September 93, Senator Nunn introduced an amendment that would
expand this authority until 30 September 94 and authorize $300
million in expenditures. Per agreement between SECDEF and
SECSTATE, however, this $ will be used to help pay peacekeeping
assessments in FY 94. Another option is to seek new, specific
legislation authorizing DOD to enter into commercial contracts for
logistics support for UN operations in Somalia. On 15 October 93,
legislation was drafted that would authorize such direct
contracting and appropriate $220 million for such (ENCL 1). It is
anticipated that this legislation could be introduced during
conference on the FY 94 DOD appropriations bill. Finally, there
is an option for our authority to contract with Brown & Root on
behalf of the UN on a reimbursable basis. Section 607 of the
Foreign Assistance Act authorizes DOD to provide such contracting
support. This would require the UN to agree to this and provide
the USG a LCA for this support. It is doubtful the UN will agree
to this arrangement, however, US/UN has been requested to approach
the UN with this proposal. Although this is the most workable of
the possible solutions, the downside is that Service O&M $ would
be used until UN reimbursement is received. To alleviate this
problem, legislation was drafted that would appropriate the seed
money for this effort (ENCL 2).

I. AUTHORIZATION LANGUAGE
Chapter 20 of title 10, United States Code is amended by
adding the following new section 404.
Section 404. Funds for contracting support to United Nations
Operations in Somalia.
(a) AUTHORITY-- The Secretary of Defense may use
appropriated funds available to the Department of Defense to pay
for the expenses of contracting support with U.S. commercial
contractors to provide logistical support, supplies, services
and equipment to United Nations Forces conducting operations in
Somalia.
(b) REPORTS TO CONGRESS-- Any funds expended under the
authority of subsection (a) shall be reported to the Committees
on Armed Services and Appropriations of the Senate and the House
of Representatives.
(c) TERMINATION-- The authority of the Secretary of
Defense to provide support under subsection (a) shall expire on
31 December 1994.
II. APPROPRIATIONS LANGUAGE.
TITLE -
CONTRACTING SUPPORT TO UNITED NATIONS OPERATIONS IN SOMALIA
(INCLUDING TRANSFER OF FUNDS)
For the expenses of arrangements with U.S. commercial
contractors to provide logistical support, supplies, services
and equipment to United Nations Forces conducting operations in
Somalia, for transfer to appropriations available to the
Department of Defense for operations and maintenance;
$220,000,000: Provided that the funds appropriated by this
paragraph shall be available for obligation for the same time
period as the appropriation to which transferred: Provided
further, that the transfer authority provided in this paragraph
is in addition to any transfer authority contained elsewhere in
this Act.

appropriated to the "Somalia Contingency Fund" which is hereby
established on the books of the Treasury: Provided, That amounts
in the Fund may be transferred to appropriations of the
Department of Defense for expenses of the Department of Defense
incurred for incremental costs in connection with carrying out
operations in Somalia and for implementation of the United
States' strategy for withdrawal of the United States armed
forces participation in such operations. Such transfer
authority is in addition to other transfer authority provided in
this Act: Provided further, That reimbursements from the United
Nations or any other source for United States armed forces
expenses incurred during fiscal year 1994 in connection with
military operations in Somalia shall be deposited to the Fund
and shall be available for transfer from the Fund to the extent
provided in appropriations and authorization Acts.

Subject: Contracting of Logistics functions in Somalia
1. Purpose. To update the DJS on the status of UN and USG
contracting in Somalia.
2. Key Points
UN Contracting:
As stated in a 12 March 93 SYG request to the US/UN, the
logistics capability provided by the US military was requested to
remain in place until other member nations or UN civilian
contractors could replace the US logistics force structure. USG
and UN high level demarches failed to produce logistics
commitments from other member states to replace this force
structure.
Discussions have been held and are continuing between US
and UN personnel regarding the contracting of these US military
logistics functions. To date, two contracts (food and fuel) have
been discussed, however, neither is close to implementation. The
food contract has recently undergone UN legal review and will
require substantial revision as a result. The UN is hesitant to
further pursue the fuel contract and any new contracts for the
following reasons:
The UN is financially constrained at the present time
and contracting is an expensive option.
The security situation has made contracting cost
prohibitive.
The UN is hesitant to contract and thereby release US
logistics structure until the UN resolution for the whole country
has been achieved. In fact, prior to the President's withdrawal
announcement, the UN was poised to ask for additional US logistics
structure to help fulfill the mandate.
Inability of the UN to pay a civilian contractor will
result in the contractor ceasing to perform the logistics
function. Inability of the UN to pay the USG will not necessarily
cause the logistics function to cease.
The UN HQ and in-country staffs are undermanned to
accommodate the volume of workload for the contracting effort.
Finally, continued US involvement with military force
structure enhances the chance of continued participation of other
national contingents in UNOSOM.
In order to assist the UN with logistics and contract
planning in general, the USG has provided nine subject matter
experts to UN HQ for a period of 60-75 days to facilitate this
process for the future.
USG Contracting:
J4 was tasked to develop the following option: USG
expands the existing LOGCAP contract with Brown & Root to assume
some or all US logistics functions. This contract expansion would
be tailored to assume those logistics functions not covered by
existing UN contracts or logistics capabilities that may be
provided by other UNOSOM contributing countries. This option
should allow US logistics personnel strength to reduce to
approximately 1400 NLT 31 December 93 and to 0 NLT 31 March 94.
Based on informal discussions with Brown & Root, they
can assume the responsibility for all logistics functions within
approximately 6 weeks of authorization. Estimated costs are
approximately $20-25 million for start up costs and approximately
$12-15 million for monthly operation costs. Total estimated cost
for a 13 month contract (Nov 93 to Dec 94) is approximately $220
million. In order to meet the established timeframes, the drop
dead date for turning on the contractor is NLT 15 November 93.
Several problems are associated with this option:
USG Equipment: In order to meet the Presidential
drawdown timeframes, the USG will be required to leave most of
it's present logistics equipment in Somalia for use by the
contractor. The actual type/quantity of equipment must be worked
out between the contractor and the USG. This equipment would be
provided to the contractor as Government Furnished Equipment (GFE)
and at the conclusion of the contract, the equipment would be
returned to the USG.
Contractor Security: Brown & Root does not provide
its own security. The present contract that expires 6 Dec 93,
requires that the USG provide this security. Additionally, the
present contract is being modified to read "The Government will
provide necessary security for Contractor personnel throughout the
Theater of Operations (TO). This includes security at the
contractor's work sites and living/messing areas, movement
throughout the TO and ingress and egress to the TO as deemed
appropriate by the in theater Contracting Officer's
Representative." With a political reconciliation and cessation of
violence, an off shore QRF may be able to provide this security.
With the resumption of violence now or after 31 Mar 94 (US
withdrawal), the contract would require security by possibly US
forces or other competent, well equipped and well trained forces.
Terms of Reference (TOR) A TOR was signed on 29
April 93 between General Hoar and LTG Bir, UNOSOM Force
Commander. The purpose of this TOR was to formalize guidance for
the staffing, organization and operation of US Forces Somalia.
Specifically, the US logistics support to be provided to UNOSOM
was spelled out in this document. On 4 May 93, Mr. Kofi Annan, UN
Under Secretary for Peace Keeping, forwarded a letter to
Ambassador Albright acknowledging receipt of the TOR and suggested
that established UN procedures (MOA) be used to govern this
relationship. The TOR was not modified to address Mr. Annan's
concerns. As a result, HQ UN does not formally recognize the TOR
as a binding document for tasking the Logistics Support Command.
Hence, the so called "mission creep" or those items not covered in
the TOR have been tasked to the Logistics Command. UN position is
that if it is a logistics mission and we give the USG a Letter of
Assist (LOA), the Logistics Command should perform the mission.
This has created problems to date and will continue once these
logistics functions are contracted.

Costs: The informal cost estimates provided by the
contractor are just that, informal. Until a. scope of work can be
provided to the contractor for actual costing of the functions, an
actual contract price cannot be determined. Based on J4 request,
CINCCENT J4/7 has tasked the Logistics Command to develop a scope
of work to be provided to the contractor once the legal authority
and funding are obtained.

Legal Authority/Funding: Presently, there is no
legal authority or funding to proceed with this option. On 9
October 93, legal representatives from the interagency met to
discuss legal issues raised by the President's Somalia exit
strategy. It was determined that DOD has limited legal authority
that would allow the USG to provide direct assistance to the UN on
a non-reimbursable basis. One such authority, Section 7 of the UN
Participation Act, is not available as it is limited to support of
operations conducted under Chapter VI of the UN Charter. Another
possible option is 10 U.S.C. 403, which authorizes DOD to provide
non-reimbursable assistance to the UN. This authority, however,
contained a "sunset" provision and expired on 30 September 93. On
10 September 93, Senator Nunn introduced an amendment that would
expand this authority until 30 September 94 and authorize $300
million in expenditures. Per agreement between SECDEF and
SECSTATE, however, this $ will be used to help pay peacekeeping
assessments in FY 94. Another option is to seek new, specific
legislation authorizing DOD to enter into commercial contracts for
logistics support for UN operations in Somalia. On 15 October 93,
legislation was drafted that would authorize such direct
contracting and appropriate $220 million for such (ENCL 1). It is
anticipated that this legislation could be introduced during
conference on the FY 94 DOD appropriations bill. Finally, there
is an option for our authority to contract with Brown & Root on
behalf of the UN on a reimbursable basis. Section 607 of the
Foreign Assistance Act authorizes DOD to provide such contracting
support. This would require the UN to agree to this and provide
the USG a LCA for this support. It is doubtful the UN will agree
to this arrangement, however, US/UN has been requested to approach
the UN with this proposal. Although this is the most workable of
the possible solutions, the downside is that Service O&M $ would
be used until UN reimbursement is received. To alleviate this
problem, legislation was drafted that would appropriate the seed
money for this effort (ENCL 2).

appropriated funds available to the Department of Defense to pay
for the expenses of contracting support with U.S. commercial
contractors to provide logistical support, supplies, services
and equipment to United Nations Forces conducting operations in
Somalia.
(b) REPORTS TO CONGRESS-- Any funds expended under the
authority of subsection (a) shall be reported to the Committees
on Armed Services and Appropriations of the Senate and the House
of Representatives.
(c) TERMINATION-- The authority of the Secretary of
Defense to provide support under subsection (a) shall expire on
31 December 1994.
II. APPROPRIATIONS LANGUAGE.
TITLE -
