SUBJECT:
Determination Pursuant to Section 2 (c) (1) of the
Migration and Refugee Assistance Act of 1962, as

Pursuant to section 2 (c) (1) of the Migration and Refugee
Assistance Act of 1962, as amended, 22 U.S.C. 2601 (c) (1), I
hereby determine that it is important to the national interest
that up to $20,000,000 be made available from the U.S. Emergency
Refugee and Migration Assistance Fund to meet the urgent and
unexpected needs of refugees, displaced persons, conflict vic-
tims, and other persons at risk due to the Kosovo crisis. These
funds may be used, as appropriate, to provide contributions to
international and nongovernmental organizations.
You are authorized and directed to inform the appropriate
committees of the Congress of this determination and the
obligation of funds under this authority and to publish it
in the Federal Register.

Emergency Refugee and Migration Account Drawdown
for Kosovo
Purpose
To obtain your authorization to use up to $20 million from the
U.S. Emergency Refugee and Migration Assistance Fund (ERMA) for
humanitarian relief related to Kosovo.
Background
Under the Migration and Refugee Assistance Act, you may
authorize assistance from the United States Emergency Refugee
and Migration Assistance Fund (ERMA) to meet "unexpected urgent
refugee and migration" needs whenever you determine it is
"important to the national interest" to do SO.
The State Department recommends use of the Fund in the amount of
up to $20,000,000 to respond to the unexpected, urgent refugee
and migration needs related to the Kosovo crisis. Serb attacks
on Kosovar Albanian villages have displaced approximately
300,000 people, and some 80,000-100,000 people are living in the
hills of Kosovo without shelter. The funds will be used to
provide contributions to the appeals of the United Nations High
Commissioner for Refugees, the World Food Program, other UN
agencies, the International Committee of the Red Cross and non-
governmental organizations.
The current balance of ERMA is $82,857,659. If this
authorization for use of the fund is approved, $62,857,659 will
remain.

SUBJECT: Emergency Fund Drawdown for Refugees, Displaced
Persons, Conflict Victims, and other persons at risk
due to the Kosovo crisis
This memorandum recommends that the President authorize the
use of up to $20,000,000 from the U.S. Emergency Refugee and
Migration Assistance Fund (ERMA) for the humanitarian situation
related to the Kosovo crisis.
The President may draw against ERMA to meet "unexpected
urgent refugee and migration needs" whenever he determines that
it is "important to the national interest" to do SO. The
Department of State believes that the President is justified in
authorizing up to $20,000,000 of funding. The need for these
funds is urgent and was not foreseen in the appropriation and
programming of FY 1998 or FY 1999 Migration and Refugee
Assistance funds. Such a drawdown from ERMA would further the
U.S. national interest by providing humanitarian support where it
is urgently needed. A supplemental appropriation is not being
considered, and the Migration and Refugee Assistance
appropriation for fiscal year 1998 is insufficient to meet this
unexpected requirement as all funds have been fully programmed.
The current balance in ERMA is $82,857,659. If this
drawdown of $20,000,000 is approved, $62,857,659 will remain.
The Department of State recommends that the President sign
the attached Presidential Determination, and in so doing approve
the attached Statement of Justification.
