China MFN Decision - Political
This memorandum provides a brief, separate note about the
politics of the upcoming China MFN the decision, primarily to
reinforce what you already know: that the politics of this
decision has many dimensions (e.g., Congressional, public, media,
short-term, long-term).
As you know, any MFN decision you make that falls short of full
revocation would be subject to a privileged resolution of
disapproval. This resolution must, however, call for full
revocation of MFN and therefore would encounter substantial
resistance. Critics could also introduce legislation imposing
sanctions short of full revocation (e.g., revoke MFN for products
from state enterprises), but this would not be privileged and
would face the same hurdles of normal legislation (e.g.,
Committee passage, Senate filibuster). We are now attempting to
assess the situation in Congress and will provide you with this
at our next meeting.
However, any readout from Congress will be murky. The views in
Congress are mixed; and there are at least three camps on this
issue - those representing human rights, foreign policy and
economic perspectives. Vote counts may be conflicting and, of
course, the vote could shift, depending on which way you lead.
As you know, there are a spectrum of views on this issue in
Congress. As you consider sanctions options, one question to ask
is whether moving more to the middle of the spectrum risks losing
potential supporters on either end.
Finally, it is important to underscore that immediate
Congressional politics is only part of the political side of this
equation. Longer-term political effects should also be
considered (e.g., retaliation against U.S. exports in the wake of
sanctions, charges that this Administration alienated and "lost"
China if sanctions are imposed, charges that China and other
nations do not take us seriously if sanctions are not imposed.)
This memorandum does not intend to answer those questions but
only to flag that the political ramifications resulting six
months and years from now must also be considered - along with
the ramifications at the time of your decision.
