With the incorporation into the EOP Security Office of the former responsibilities of the
White House Office of Personnel Security, we have drafted a uniform set of procedures for
the EOP Security Office. Because these procedures will govern how security investigations
for your staff will be conducted, and will govern your access to information, we are
circulating the draft for your comments.

CLASSIFIED INFORMATION NONDISCLOSURE AGREEMENT
AN AGREEMENT BETWEEN
AND THE UNITED STATES
(Name of Individual - Printed or typed)
1. Intending to be legally bound, I hereby accept the obligations contained in this Agreement in consideration of my being
granted access to classified information. As used in this Agreement, classified information is marked or unmarked classified
information, including oral communications, that is classified under the standards of Executive Order 12356, or under any other
Executive order or statute that prohibits the unauthorized disclosure of information in the interest of national security; and
unclassified information that meets the standards for classification and is in the process of a classification determination as
provided in Sections 1.1 and 1.2(e) of Executive Order 12356, or under any other Executive order or statute that requires
protection for such information in the interest of national security. I understand and accept that by being granted access to
classified information, special confidence and trust shall be placed in me by the United States Government.
2. I hereby acknowledge that I have received a security indoctrination concerning the nature and protection of classified
information, including the procedures to be followed in ascertaining whether other persons to whom I contemplate disclosing this
information have been approved for access to it, and that I understand these procedures.
3. I have been advised that the unauthorized disclosure, unauthorized retention, or negligent handling of classified information
by me could cause damage or irreparable injury to the United States or could be used to advantage by a foreign nation. I hereby
agree that I will never divulge classified information to anyone unless: (a) I have officially verified that the recipient has been
properly authorized by the United States Government to receive it; or (b) I have been given prior written notice of authorization
from the United States Government Department or Agency (hereinafter Department or Agency) responsible for the
classification of the information or last granting me a security clearance that such disclosure is permitted. I understand that if
I am uncertain about the classification status of information, I am required to confirm from an authorized official that the
information is unclassified before I may disclose it, except to a person as provided in (a) or (b), above. I further understand that
I am obligated to comply with laws and regulations that prohibit the unauthorized disclosure of classified information.
4. I have been advised that any breach of this Agreement may result in the termination of any security clearances I hold;
removal from any position of special confidence and trust requiring such clearances; or the termination of my employment or
other relationships with the Departments or Agencies that granted my security clearance or clearances. In addition, I have been
advised that any unauthorized disclosure of classified information by me may constitute a violation, or violations, of United
States criminal laws, including the provisions of Sections 641, 793, 794, 798, and *952, Title 18, United States Code,
*the provisions of Section 783(b), Title 50, United States Code, and the provisions of the Intelligence Identities Protection Act
of 1982. I recognize that nothing in this Agreement constitutes a waiver by the United States of the right to prosecute me for any
statutory violation.
5. I hereby assign to the United States Government all royalties, remunerations, and emoluments that have resulted, will result
or may result from any disclosure, publication, or revelation of classified information not consistent with the terms of this
Agreement.
6. I understand that the United States Government may seek any remedy available to it to enforce this Agreement including,
but not limited to, application for a court order prohibiting disclosure of information in breach of this Agreement.
7. I understand that all classified information to which I have access or may obtain access by signing this Agreement is now and
will remain the property of, or under the control of the United States Government unless and until otherwise determined by an
authorized official or final ruling of a court of law. I agree that I shall return all classified materials which have. or may come into
my possession or for which I am responsible because of such access: (a) upon demand by an authorized representative of the
United States Government; (b) upon the conclusion of my employment or other relationship with the Department or Agency
that last granted me a security clearance or that provided me access to classified information; or (c) upon the conclusion of my
employment or other relationship that requires access to classified information. If I do not return such materials upon request.
I understand that this may be a violation of Section 793, Title 18, United States Code, a United States criminal law.
8. Unless and until I am released in writing by an authorized representative of the United States Government, I understand
that all conditions and obligations imposed upon me by this Agreement apply during the time I am granted access to classified
information, and at all times thereafter.
9. Each provision of this Agreement is severable. If a court should find any provision of this Agreement to be unenforceable,
all other provisions of this Agreement shall remain in full force and effect.
10. These restrictions are consistent with and do not supersede, conflict with or otherwise alter the employee obligations, rights
or liabilities created by Executive Order 12356; Section 7211 of Title 5, United States Code (governing disclosures to Congress);
Section 1034 of Title 10, United States Code, as amended by the Military Whistleblower Protection Act (governing disclosure
to Congress by members of the military); Section 2302(b)(8) of Title 5, United States Code, as amended by the Whistleblower
Protection Act (governing disclosures of illegality, waste, fraud, abuse or public health or safety threats); the Intelligence
Identities Protection Act of 1982 (50 U.S.C. 421 et seq.) (governing disclosures that could expose confidential Government
agents), and the statutes which protect against disclosure that may compromise the national security, including Sections 641,
793, 794, 798, and 952 of Title 18. United States Code, and Section 4(b) of the Subversive Activities Act of 1950 (50 U.S.C.
Section 783(b)). The definitions, requirements, obligations, rights, sanctions and liabilities created by said Executive Order and
listed statutes are incorporated into this Agreement and are controlling.

2. FBI FILES - At a Congressional hearing today, FBI general counsel Howard
Shapiro denied allegations about Hillary Rodham Clinton's involvement in the
hiring of Craig Livingstone by the White House. Livingstone resigned his
position this summer after it was revealed that his office had improperly
acquired the FBI files of hundreds of former White House employees. Shapiro
said the FBI had not acted improperly by notifying the White House that a
former FBI agent had notes of a conversation in which then-White House counsel
Bernard Nussbaum allegedly said Mrs. Clinton had asked that Livingstone be
hired. Shapiro also defended the FBI's questioning of the former agents about
the notes. (4:00)
3. BOEING-ROCKWELL - NPR's Jim Zarrolli reports that Rockwell International
Corp., known for B-1 bombers and space shuttles, agreed today to sell the bulk
of its aerospace and defense businesses to Boeing in a $3 billion deal. Boeing
will issue $860 million in stock and assume $2.2 billion in Rockwell debt to
strengthen the defense and space businesses that complement its position as the
world's biggest maker of jetliners. (4:00)

4. US 427 - Noah talks with Jonathon Harr about his article, "The Crash
Detectives," in this week's New Yorker magazine. Harr summarizes the National
Transportation Safety Board investigation into the 1994 crash of U-S Air flight
427 in Pittsburgh. The cause of the crash remains unknown but there are several
theories about what may have happened. (12:00)

7. WELFARE CHANGES - The welfare bill that's expected to pass the Senate
today will undo sixty years of U.S. policy for aiding the country's poorest
citizens. It eliminates the entitlement of destitute people to benefits,
awarding benefits only for five years and requiring recipients to work after
two years. It will hand over to states the responsibility of providing for the
poor, using the criteria each state sees fit. The bill also adds restrictions
to Medicaid, food stamps, and a variety of social programs. NPR's Peter Kenyon
reports. (4:30)
8. NEW DEAL - Archive tape of President Franklin Delano Roosevelt and copy
about the beginning of the New Deal. (1:00)
9. WHAT YOU EXPECTED - Noah talks to Robert Nathan, who was a consultant to
FDR's Commission on Economic Security. Nathan says that the original goal of
the New Deal was to give people jobs whether or not it was cost effective, not
to give them checks from the government. (3:30)
10. Whitewater - NPR's Jon Greenberg reports on the acquittal in the second
Whitewater trial in Little Rock. (2:00)

11. PRIEBKE CLEARED - David Willey reports that former Nazi SS Capt. Erich
(eric) Priebke (PREEB-keh) was absolved today of the most serious charges he
faced in the World War II massacre of 335 Italian civilians. The military court
ordered him set free. In what was likely one of the last Nazi war crimes
trials, the court found Priebke guilty of taking part in the reprisal killings
- which he admitted - but cleared him of acting with cruelty and premeditation
because he was only following orders. That finding put the crime beyond the
statute of limitations. Priebke, 83, faced life imprisonment for the March 24,
1944, executions. (2:30)
12. NEW POLL - Linda talks to Andy Kohut, Director of the Pew Research Center
for the People and the Press, about a new poll that ascertains Americans'
opinions about the Presidential campaign. Most people are bored with the
campaign and most expect President Clinton to win. (5:00)

13. WIRE TAPS - NPR's John Neilsen reports that during the Clinton
Administration federal use of wiretaps has been up sharply. Now the FBI and
Justice Department want to make it easier to monitor conversations on
everything from telephones to computers. Civil liberties experts say the
changes will not help reduce the terrorist threat. (5:00)
14. PHONE REGS - NPR's Barbara Bradley reports that today the Federal
Communications Commission is issuing new rules intended to make local phone
service more competitive. The unanimous F-C-C vote completes an overhaul that
opens the local marketplace to long distance and cable T-V companies as well as
other competitors. About a dozen states are working to get competitors into
their local phone businesses to go head to head with the regional Bell
companies. The so-called Baby Bells have had a lock on the market until now.

(PAH-vee) at his studio in Lafayette, Louisiana to see his work in a style Pavy

Today Representative William Clinger, hiding behind the
statement,
and
legal fig leaf of the speech and debate clause, took the
Nussboum
extraordinary step of divulging on the House floor highly

confidential and completely false information from an FBI
background investigation.
Congressman clinger has failed utterly to prove that the
White House ever improperly released any private information from
FBI files. Thus, today's astonishing speech by Mr. Clinger
represents the first and only disclosure of confidential FBI
background information during this entire matter.
What is worse, Congressman Clinger divulged confidential
information that is clearly false and that originates from a
questionable source. Bernard Nussbaum has said that the alleged
conversation between Mr. Nussbaum and FBI Agent Dennis
Sculimbrene never took place. In addition, Mr. Clinger surely
knows that, according to a published report, an FBI agent
informed his superiors that Agent Sculimbrene harbored "very

Sculimbrene's FBI interview report states that Mr. Bernard Nussbaum was the
individual who informed him (Sculimbrene) that Mr. Livingstone received his job
because of a pre-existing relationship between Mrs. Livingstone and Mrs. Clinton.
According to a news account, FBI agent David Bowie, who worked with Sculimbrene, wrote
in an August, 1995 memo that Sculimbrene had "very bitter political feelings against the
White House." Bowie further accused Sculimbrene of "irrational" behavior. [The

Sculimbrene is involved in an employment dispute with the FBI, alleging he was
discriminated against because of his handicap. (Sculimbrene suffered a severe head injury
after being hit by a propeller.) Sculimbrene has been quoted by another FBI agent as saying,
"he could get away with anything" because he was disabled. [The Washington Post, 6/29/96]
In a news account, Sculimbrene stated the FBI was seeking retribution for his testimony in
the Dale trial. (Sculimbrene testified on behalf of Billy Ray Dale at Dale's trial for

convictions who felt a kinship with the Bush administration and was openly
disgusted when Bill Clinton captured the Oval Office.
"He was very cozy with most of the Bush staff," said an FBI agent who knows
Aldrich and spoke on the condition of anonymity. There is "no doubt he has a
phenomenal bias" against the Clintons.
"He was almost personally offended that the Clintons had won, and made no
secret of that," the agent said. After Clinton was elected president, the agent
said, Aldrich remarked, "I've never seen so many ponytailed, 50-year-old men in
my life. "
Aldrich, a 26-year veteran of the FBI, retired last year because, he has
suggested, his experience in the Clinton White House soured him on the bureau.
He had spent the last five years of his career as one of two FBI agents assigned
to the White House, where he was responsible for conducting background
investigations on White House personnel.
In his controversial new book, "Unlimited Access: an FBI Agent Inside the
Clinton White House, Aldrich described his post as an elite assignment that
afforded him the unique opportunity to look out the window and see "a king or a
queen visiting the president "
But the FBI post at the White House has also been the subject of considerable
controversy, particularly during the Clinton administration. One of the agents
who helped with White House background checks in 1994 and 1995, Halbert Gary
Harlow, was charged and eventually convicted last year of falsifying at least 50
interviews that he claimed to have conducted.
Aldrich was assigned to full-time duty at the White House with agent Dennis
Sculimbrene, who almost lost his life in a 1995 accident, and has been quoted by
another FBI agent as saying "he could get away with anything" because he was
disabled. Sculimbrene is involved in a legal dispute with the FBI over his work
assignments. He alleges he is being discriminated against because of his
disability.

The FBI response to the allegations raised in Aldrich's book was a terse,
two-paragraph statement saying that Aldrich had published his account without
completing a required bureau review process.
As a condition of FBI employment, all employees and former employees are
required to submit for review any publications that "could have been based on
knowledge gained as a result of their employment," the FBI release said. "The
purpose of this review is to ensure the integrity of the investigative or other
official information employees learn as part of their official duties."
Jay Stephens, Aldrich's lawyer and former Republican U.S. attorney for
Washington, said yesterday that over the last six months he and his client had
worked closely with the FBI to address any concerns the agency may have about
the manuscript.
"We substantially met all their concerns except for a couple of very limited
passages that have become moot as a result of the hearings into problems in
security clearances at the White House," Stephens said.
However, a senior bureau official disputed Stephens's account, saying that
substantial issues remained unresolved before the book's publication.
Some senior bureau officials yesterday appeared caught in the position of
trying to respond to a book with some credible allegations and other claims they
considered undocumented rumor.
"Are we outraged by this behavior?" asked one senior bureau official. "Of
course we are. But the official said that the bureau hasn't decided what to do
about the book and noted that Aldrich does have First Amendment rights.
Should it decide to take action against Aldrich for publishing before the
review process was completed, the bureau's only option is to pursue civil
litigation to control profits of the book, said one source.
Upon first receiving the book, the FBI forwarded it to its Office
Professional Responsibility as a part of routine procedure. Thus far the bureau
has not been able to secure documents to substantiate Aldrich's claims about
security procedures at the White House, sources said.
Aldrich first surfaced publicly two weeks ago, just after the controversy
erupted over the White House's improper receipt of hundreds of FBI files, when
he published an op-ed piece assailing the Clinton administration in the Wall
Street Journal. In it, he accused the White House of thwarting security and
background checks. He made no mention of the upcoming book.
The book describes the early Clinton White House as being in complete
disarray, rife with staff members who had once been drug abusers, suffering from
lax security clearance procedures and targeting employees that it wanted fired
to make room for individuals who were viewed as loyal to the Clintons. He also
claimed that the FBI ignored repeated complaints that the Clinton administration
was allowing staff members to go long periods of time without permanent White
House passes.
FBI sources said they had not yet been able to find any record of the
complaints Aldrich said he had lodged.

the deposition of John Libonati.
3
We want to provide you with brief information concerning
4
the investigations. Pursuant to authority under Rules 10 and
5
11 of the House of Representatives, the Government Reform and
6
Oversight Committee is investigating the White House Travel
7
Office matter and related issues, events leading up to the
8
firings and the various investigations that have been
9
conducted of the firings and related activities.
10
The investigation also encompasses the activities of
11
Harry Thomason, Darnell Martens and Penny Sample at the White
12
House, as well as allegations of wrongdoing concerning the
13
Travel Office employees.
14
We are reviewing actions taken by the FBI and Justice
15
Department both prior to and after the firings, as well as
16
issues relating to the the White House receiving FBI
17
background investigations on prior administration officials
18
and also ongoing, current, holdover employees.
19
The investigation includes but is not limited to the
20
investigation and prosecution of Billy Dale and related
21
matters. Various investigations that have been conducted are
22
the White House Management Review, the FBI and Justice
23
reviews, both criminal and OPR at Justice, also IRS and
24
Treasury Department internal reviews, a GAO review and a U.S.
25
House of Representatives Resolution of Inquiry in July of

'93.

The committee has been granted specific authorization to
3
conduct these depositions pursuant to House Resolution 369
4
which was passed by the House of Representatives on March 7,
5
1996, and pursuant to committee Rule 19 which we need to
6
provide to you so you have it today. Both Majority counsel
7
and Minority counsel will be afforded an equal opportunity to
8
pose questions to each witness.

As we are proceeding, if you have any questions that you
10
need to ask me about the questions that I ask you, or
11
clarification, you can talk with your counsel or check with
12
me. Any objections, we would like to have stated for the
13
record, and there are some areas that we may need to resolve
14
in writing.

It is a 5-day time period in which you can review your
16
deposition, once it has been transcribed, to correct any
17
problems in it or any changes that might be needed.

You are here today voluntarily and not by subpoena?

a witness, was called for examination by Counsel, and after
4
having been first duly sworn, was examined and testified as
5
follows:

EXAMINATION BY MS. COMSTOCK:

Q
I just want to directly go into the issue of the FBI
8
files and the various lists that have been -- strike that.
9
I believe this was the first list that was provided by
10
the White House, which was dated at the top January 20, 1993.
11
A
That is correct.
12
Q
It begins with Abdoo and ends with Julie Goldberg.
13
This was the second list which began with Carol-something,
14
A-A-R-O-S, and ends with Glen. Are those the two lists
15
essentially we are working off of in reviewing the work that
16
you all have done?
17
A
They appear to be; that is correct.
18
Q
If you could, just explain to us essentially how the
19
names that came up on these two lists could not have been
20
produced from Secret Service active lists.
21
A
Okay. In reviewing these lists, there are several
22
methods by which to do that. Obviously there are technical
23
computer audits which I think would be better addressed by the
24
people that conduct those.
25
To begin with, many of the people on this list were made

inactive between the time periods of 1984 and 1989. The
2
E-PASS system was not installed until '89, so these people
3
were passholders by a different system and not by a computer
4
system.
5
Q
If we could back up, were you at the White House?
6
A
I was Branch Chief of the, at that time commonly
7
known as the Pass Section, but it is the Access Control
8
Branch. I was the Branch Chief from early '89 until the end
9
of 1991.
10
Q
So you were there when the system changed over?
11
A
That is correct. I was the supervisor in charge
12
of - - there was a Project Manager, and I was the supervisor in
13
charge of the branch.
14
So in 1989 the system was installed. All of the people
15
from this list that went inactive from '84 up to and through
16
'89 were downloaded into the E-PASS computer system as
17
inactive passholders in bulk. So I believe the number of 94,
18
as indicated on this chart, it was downloaded en masse as
19
inactive passholders.
20
In discussing these 94 people with our technical
21
auditors, they indicated that these 94 people were made
22
inactive in that time period and that they were never made
23
active since that time period. Perhaps to best illustrate
24
that would be to cover or to review the printouts that are
25
generated from E-PASS, whether they were inactive printouts or

active printouts, any printouts that would indicate the status
2
of these people would be a good judge of whether or not they,
3
in fact, were downloaded and remained inactive.
4
On an inactive list which was recovered in August '91,
5
182 people from this subject list, the combined two lists that
6
were provided to us, 182 of those people were reflected on
7
this inactive passholders list, and included amongst the 182
8
were the 94 people that were downloaded between '84 and '89.
9
So we know up to this point in time that these 94 and the
10
additional, adding up to 182 from this list, were inactive as
11
of August '91.
12
We move on to an active passholders list, generated by
13
the same computer system, and that list was recovered and was
14
dated May 2, 1993. It is an original.
15
On that active passholder list, 368 of the people from
16
these two combined lists were not on that list and should not
17
have been on those lists, because if they were inactive, they
18
would not appear on an active passholder list. Amongst these
19
368 were the 94 people that were downloaded in 1989, which
20
shows clearly that that inactive status has remained. In
21
addition to the audits, we have these computer printouts that
22
were generated, be they inactive or active. Again, we have
23
consistency.

If we then move on to a list that we recovered, an active
25
passholder list, and the date of that list was July 8, 1993,

an original WAVES printout from the same system, 379 of the
2
people from these combined two lists, if they were active,
3
would have appeared on the July 8th list, and in fact they did
4
not and they should not. Amongst the 379, if you worked back
5
to the 94 people downloaded in 1989, they were not on that
6
active passholder list. If they were active, they would have
7
appeared on these two 1993 lists; if they were inactive, they
8
would have appeared and did appear on the August '91 list.

In addition to technical audits that were conducted to
10
check on the status of these people, we recovered original
11
lists generated from those computer databases and those
12
printouts clearly reflect that the vast majority of people on
13
this list that were inactive people were accurately reflected
14
as inactive and we can conclude 'that in fact they did not
15
appear on active lists during this time period, and would have
16
appeared on any inactive list during this time period.

Q
So any master list that would have included active
18
and inactive would have had - - as of July 8th, would have
19
had -- 379 of these people would have been listed as
20
inactive?
21
A
As inactive, and on the master list to which you
22
refer, that status is reflected by an "A" or an "I", "A"
23
meaning active, "I" meaning inactive. That master list is
24
approximately 24,000 names of active and inactive passholders
25
going back to approximately 8 years, and these people would

have been on that list as inactive passholders. So yes, they
2
would have been on a list, but reflected with the "I" as
3
inactive under this field status.

Q
From the printouts, when there are printouts on
5
these computer-generated sheets from the Secret Service, they
6
have dates on them?
7
A
The batch date. The day the computer printout is
8
generated, that date would be reflected on that printout.
9
Q
So any list that you would have given to anyone in
10
the Office of Personnel Security --
11
A
Would have a run date.

Q
If someone had wanted to look at, do I have an
13
outdated list here or not, they could have looked at the run
14
date?
15
A
That is correct. Even that term would perhaps be
16
inaccurate, because if someone were to recover a list from
17
this date, even today, while the list is old, the information
18
relative to that time period was reflected accurately. So the
19
term "outdated" might mean that it is a list from a date past,
20
but nevertheless the information contained on the lists that
21
we recovered was accurate for that time period.

Q
Now, there are other people who were A to Gs who are
23
inactive, other than people who were on this list, right; in
24
the big master list there would be others -- I notice in the
25
Senate testimony Senator Abraham noted that he would have been

on a master list as inactive as of whatever date.

A
Yes. There are other inactive people on that list
3
within the field A-A to G-O on the general list; that is
4
correct.

Q
In the past month or so since these -- the existence
6
of these FBI files having been inappropriately gathered for
7
whatever reason by the White House Office of Personnel
8
Security, have you had any discussions with Craig
9
Livingstone?
10
A
No, I have never had any discussions to my
11
recollection with Mr. Livingstone.

Q
Did anyone from the White House Counsel's Office
13
ever contact you to talk to you about these matters?
14
A
No, I have not had a contact with them.
15
Q
Or any of Mr. Livingstone's attorneys?
16
A
No.

I
Do you have any knowledge of any problems that arose
18
with the Secret Service dealing with Craig Livingstone at any
19
time?
20
A
Not that I am aware of. That would not be something
21
I would be aware of.

Did your office ever work with George Saunders? Do
23
you know what George Saunders did in terms of dealing with the
24
files?
25
A
During my time period Mr. Saunders conducted

security briefings of people that were coming on board at the
2
White House and played that kind of a role in relation to the
3
White House Office of Security.

Q
Did Mr. Saunders ever raise with you any issues with
5
the new administration and them not moving files along?
6
A
I was only there until 1991. I left that position
7
during the previous administration, so I would have had no
8
dealings with him as it relates to the current
9
administration.

Q
But did he ever in the context of the current
11
administration have conversations with you?
12
A
No. I haven't conversed with him that I can recall
13
since I left that position.

Q
Would it be correct that there was no active list
15
produced by the Secret Service at any time, I guess going back
16
to 1989 or I guess 1984, because some of these people are from
17
1984, that could have produced all of these 477 names as
18
active?
19
A
It would be my conclusion that the Secret Service
20
databases would not have reflected nor produced or generated a
21
list that would have had all of these people listed as active
22
from the time the 94 names were downloaded in 1989 even up to
23
the current time.

You worked in the White House until 1991 and have

not been there since then?

A
I worked in that particular position from February
5
of 1989 to late 1991 as Branch Chief of the Access Control
6
Branch. I have not held a position at the White House complex
7
since that time.

Were you at all involved with the GAO doing the
11
review of the White House passes and security clearances?
12
A
I am familiar with it, but I was not involved in the
13
study personally.

Were you aware of any meetings that the Secret
15
Service had with the White House at the time of the GAO
16
reviews, I guess it was initiated in March of 1994 and going
17
throughout 1995 in terms of trying to make changes or - -
18
A
I wouldn't have any firsthand knowledge of that.

I guess that is all I have for you. We covered most
20
