e. Ms. Smith Becomes Aware of Peter Hall's Drug Activities
By the fall of 1991, Ms. Smith's relationship with Peter had solidified. They were living in
Peter's off-campus apartment at the start of the school year and, despite the incidents of abuse over
the previous summer, Ms. Smith was in love with him. App. 1 at 7. In September, after Peter was
arrested for trespassing at Hampton University, Ms. Smith learned that he had pending state drug and
fake identification charges. Tr. Sent. 130. Ms. Smith later testified that Peter also told her for the
first time that he had a New Jersey charge against him from his childhood. Tr. Sent. 77. Still,
however, Ms. Smith did not know the entire truth about Peter's situation. As Ms. Smith later
recalled, "I was devastated. [Peter] was somebody I cared about. I didn't know anybody who'd been
to jail before. I felt I had to help him.
He was saying he was scared to tell me about his past
because he thought I would leave him. I believed him. He said he was going to change his
lifestyle." App. 1 at 7.
Just prior to Christmas, after Peter gained his released, he assured Ms. Smith that he was
going to change his life around and start from a clean slate. Ms. Smith, eager to support Peter,
invited him to her family's home for Christmas. According to Gus and Odessa Smith, the Peter that
they met that day was articulate and polite. Id. Just as he had acted in developing his relationship
with Kemba, Peter was less than honest when discussing his situation with Gus and Odessa. In fact,
Peter told "Mr. Smith," as he addressed Ms. Smith's father, that he had been jailed only because he
