March 22nd, 1921. Miss Gertrude Elisabet Mill, e/o H. F. Burnett, 2718 Arthington Street, Chicago, Illinois. but not taken, filed with our representative at the port of debarkation of MyWienr your claim for salary in lieu of vacation earned upon your return from service in Siberia, we beg to quote the clause the Siberian contract governing this question: "B is allowed a vacation of two weeks per year with pay, but no expenses or maintenance. This vacation may be taken at any time after the com- pletion of six months' service." In view of the many similar claims lodged with us in this connection, we requested the Siberian Commission for a ruling in this regard, which we quote below: "Your answer to our No. 251 concerning the payment of salary for vacation periods not actually taken has settled a much debated point which we felt should be straightened out by reference to the gen- eral Red Cross principle followed elsewhere. On your decision to "pay salary covering vacation earned but not taken", we shall pay two weeks' salary to all those who have served a year with the Siberian Commission, such year dating from the period when their salary began to the period of their discharge and thus covering their travel by sea to and from Siberia. This will conform with our Siberian con- tract, which reads that personnel are entitled to a vacation of two weeks upon a year of service. This twc weeks may be taken, under our contract, at the convenience of the Commission after six months of actual service. We cannot assume, however, that this privilege of taking the two weeks at the end of six months' service entitles the personnel to a vacation as "earned", eince the two weeks" vacation is for 2 year's service. Therefore, those who have served nore than six months and less than a year without vacation are not entitled to salary for vac- ation "earned", but not taken."
