Office of Admi ,st1 1on, os The Secretary September 3, 1953 through The Under Secretary Fordyce W. Luikart Hearing Appeals on Sex Deviation Cases The The attached file contains: a. Memorandum from the Deputy Director of Personnel presenting the special problem of establishing appellate pro- cedures for sex deviation cases and explaining the basis for the procedures recommended. b. A proposed statement to be signed by you, if you approve, which would authorize the establishment of a Hearing Committee. This procedure would be distributed to appropriate staff officials and heads of constituents only for their informa- tion. I wish to call to your attention the two most significant points involved in this proposal: 1. The composition of the proposed Hearing Committee, namely, the General Counsel, the Director of the Office of Field Services, and the Director of Administration. 2. The principle that there should be one hearing and that the composition of the appellate panel shall not include anyone who has been involved in the original decision. I recommend that you sign the proposed statement and that it be distributed to appropriate staff officials and heads of constituents. Attachment FWL/rrm Secutanp's copy
