Dear Phil:
I am taking the liberty of writing to you about Judge Edward V. Healey, Jr.,
of Rhode Island. You will recall meeting him when you very kindly permitted
our visit to you last May while he and I were in Washington at a meeting re-
garding the use of data systems in the courts. At that time he was the
President of the National Council of Juvenile Court Judges, on whose Board of
Trustees I have the privilege of serving.
Your courtesy in seeing us was even more appreciated because that was the
morning after the nearly all-night session you had over the captured American
ship in Asian waters - and you had an early morning bout with your dentist.
The reason for my letter is to recommend to you, for whatever further use you
deem appropriate, Judge Healey's name for the United States District Court
currently vacant in Rhode Island. Certainly this is presumptuous on my part
but I am writing because I feel strongly that he is a man who has proved his
excellent capabilities as a lawyer and judge, of national reputation, and also
as a man and judge with unusual and unique compassion for people and respect
for the law.
His credentials are fantastic, he has great respect in the legal profession
and in his State (as well as far beyond) and he would be an excellent Federal
Judge.
Further, you will note that he is an active Republican in an area where that
posture is not always the most popular. I am convinced that persons of both
parties as well as the legal profession would concurr on him as an excellent
choice.

1952 - Served as Campaign Manager for Mayoralty Campaign
for Christopher DelSesto, running as a Republican
fusion candidate.
1954-1956 - Served as Chairman of the Second Congressional
District Rhode Island Republican Search Committee.
1956 - Served as Campaign Director for campaign of Chris-
topher DelSesto, Republican candidate for Governor,
Congressional candidates and other state officers.
1958 - Served as Campaign Director for Christopher Del
Sesto, candidate for Governor, who successfully
won the election. He was the first Republican
elected in 20 years.
Served as his Executive Director from the day
of Governor DelSesto's inauguration until
February 1, 1960, when I assumed office of the
Judge of the Juvenile Court of Rhode Island.
During various gubernatorial campaigns, arranged
motorcades in conjunction with staff of then
Vice-President Nixon together with secret service.
1968 - Served as faculty member for National College of
Brobate Judges, New England Probate Seminar,
Harvard University, April 4-5, 1968.
1975 - Attended National Conference on Appellate Justice

Dear Phil:
As you may know, there is a vacancy on the
United States District Court for the District
of Rhode Island, due to Judge Edward Day reach-
ing age 70 and retiring to Senior Judge status.
Apparently, there are several potential candi-
dates, as follows:
Judge Joseph R. Weisberger, Presiding
Judge of the Superior Court of the
State of Rhode Island.
Honorable Herbert DeSimone, Former
Attorney General of Rhode Island,
Republican candidate for Governor,
and Assistant Secretary of Trans-
portation.
Lindsey Almon, United States Attorney
I know all of these men personally, and while
they are all honest and intelligent, the quali-
fications of Judge Weisberger to be a federal
district court judge are, in my opinion, much
superior to the others. He has proved to be
a very hard working judge on the Superior Court.
He is considered probably the most brilliant of

all Superior Court judges, and although he has
been on the bench for many years, there never
has been the slightest criticism of him. He
is an excellent administrator. I have been
before him myself on a few occasions, and can
speak from personal experience.
I frankly have no knowledge of which candidate
the administration favors, but I do have enough
personal knowledge of all three men to be able
to state the opinion given in this letter.
Incidentally, Judge Weisberger is by no stretch
of the imagination a personal friend of mine,
and I know him only professionally, although we
were classmates at the Harvard Law School.

As you know, Judge Tyler has been handling the DeSimone
or Weisberger reviews for consideration in connection
with the U.S. District Court vacancy in Rhode Island.
He was handling these in any event, but I was away at
the Judicial Conference in Spokane. The DeSimone files
came to my desk this afternoon. I have had about twenty
minutes in which to read them -- hardly the basis for a
considered opinion! I understand there is a need for
speed. In this situation, and with your concurrence, I
am sending to you the two files.
