Attached for your consideration is H.R. 17026, sponsored
by Representative Gray, which provides former Speakers
of the House of Representatives with staff assistance,
office space, supplies and equipment for as long as each
former Speaker determines is necessary to handle mail
and conclude business relative to his tenure as Speaker.
OMB recommends approval and provides you with additional
background information in its enrolled bill report. (Tab A)
Bill Timmons and Phil Areeda both recommend approval.

Discussion
H. Res. 1238 of the 91st Congress provided House Speaker John
McCormack with office space, staff assistance, office supplies,
and equipment for a period of two years from the time he retired
as Speaker at the end of the 91st Congress. The provisions of
H. Res. 1238 were made permanent for Mr. McCormack as part of
the Supplemental Appropriations bill for 1971 (P.L. 91-665).
H.R. 17026 would extend the provisions of H. Res. 1238 to all
former Speakers of the House of Representatives. It would
provide former Speakers with up to two staff aides, office
space, stamps, stationery, telephone, and related office equip-
ment. These provisions would be available for as long as each
former Speaker determined that they were necessary to help in
the handling of mail and the conclusion of business related to
his tenure as Speaker.

The staff and supplies would not be available for any period
during which the former Speaker held an elective or appointed
office or position with either the Federal or the District of
Columbia Government for which more than a nominal salary is
received or for a former Speaker who was expelled from the
House.
The House and Senate Public Works Committees estimate the
costs of this bill to be $16,250 for fiscal year 1975, and
$32,500 for fiscal years 1976 to 1980.

Dear Mr. Ash:
By rèferral dated December 11, 1974, from the Assistant Director
for Legislative Reference, your office requested the views of the
General Services Administration on enrolled bill H. R. 17026,
93rd Congress, an act "Relating to former Speakers of the House
of Representatives."
H. Res. 1238, 91st Congress, provided retiring Speaker McCormack,
for a period of two years, with certain office space, furniture,
equipment, furnishings, office expenses, telephone service, franked
mail privileges, postage, staff salaries, and stationery and other
office supplies. This was made permanent law by Chapter VIII of
the Supplemental Appropriations Act, 1971 (Public Law 91-665,
approved January 8, 1971).
H.R. 17026 would make these provisions applicable with respect to
any former Speaker of the House of Representatives for as long as
he determines there is need therefor, except for any period during which he
holds an appointive or elective office or position in the Federal or
District of Columbia Government at other than nominal pay, and unless
he was separated from service by expulsion from the House.
GSA has no objection to Presidential approval of the enrolled bill.

The Committee on Public Works, to whom was referred the bill
(H.R. 17026) relating to former Speakers of the House of Repre-
sentatives, having considered the same, report favorably thereon with-
out amendment and recommend that the bill do pass.
PURPOSE
This bill extends for SO long as each former Speaker of the House
of Representatives determines there is a need therefor, the provisions
of House Resolution 1238, 91st Congress, as heretofore enacted into
permanent law. House Resolution 1238 provides for up to two staff
members, office space, stamps, stationery, telephone, and related office
equipment.
VOTE
H.R. 17026 was reported unanimously by the Committee on Octo-
ber 3, 1974, by voice vote.
COSTS OF THE LEGISLATION
In accordance with rule XIII (7) of the Rules of the House of
Representatives, the estimated costs to the United States which would
be incurred in carrying out H.R. 17026, as reported, in fiscal year 1975
and each of the following 5 years are set forth herein. The estimate
which has been prepared by the Committee is based on the best avail-
able information.
Fiscal year: 1975, $16,250; 1976, $32,500; 1977, $32,500; 1978, $32,-

The Committee on Public Works, to which was referred the bill
(H.R. 17026) relating to former Speakers of the House of Repre-
sentatives having considered the same, reports favorably thereon with-

GENERAL STATEMENT
This legislation provides former Speakers of the House of Repre-
sentatives with staff assistance, office space, supplies and equipment.
These will be available SO long as each former Speaker determines
that they are necessary. The bill makes permanent the provisions of
House Resolution 1238, 91st Congress, which authorizes up to two
staff aides, office space, stamps, stationary, telephone, and related
office equipment.
VOTE
Section 133 of the Legislative Reorganization Act of 1970 requires
that rollcall votes taken during consideration of this legislation be
reported. The bill was ordered reported without a rollcall vote.
COST OF LEGISLATION
Section 252 (a) (1) of the Legislative Reorganization Act of 1970
requires publication in this report of the committee's estimate of the
costs of reported legislation. These estimates are as follows: Fiscal
year: 1975, $16,250; 1976, $32,500; 1977, $32,500; 1978, $32,500; 1979,
$32,500; and 1980, $32,500.

An Act
Relating to former Speakers of the House of Representatives.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled, That (a) the pro-
visions of H. Res. 1238, Ninety-first Congress, as enacted into perma-
nent law by the Supplemental Appropriations Act, 1971 (84 Stat.
1989), are hereby extended to, and made applicable with respect to,
each former Speaker of the House of Representatives, as long as he
determines there is need therefor, commencing at the expiration of
his term of office as Representative in Congress.
(b) Subsection (a) shall not apply with respect to any former
Speaker of the House of Representatives for any period during which
such former Speaker holds an appointive or elective office or position
in or under the Federal Government or the government of the District
of Columbia to which is attached a rate of pay other than a nominal
rate or to any former Speaker separated from the service by reason
of expulsion from the House.
