COUNTY OF JACKSON)
Be it remembered that on this sist day of bugunt 1943
before me, the undersigned Notary Public, personally appeared
T. B. Wallace, to me personally known/who being duly sworn, makes
oath and says+
I have lived in Jackson County, Missouri all of my life, except
two years, during which time I lived in Wisconsin. I am one of the
brothers of William H. Wallace and John C. Wallace, both now deceased,
who bought from the heirs of E. B. Hollaway in the year of 1883 the
East half of the north=west quarter and the West half of the North-
east quarter and the East half of the North-east quarter of the
Southwest quarter of Section 30, and the North half of the Southeast
quarter of Section 30, except a rectangular tract out of the North-
east corner thereof, 36.25 poles east and west by 18.64 poles north
and south, and the Southwest quarter of the Southeast quarter of
Section 30, all in Township 48, Range 30 in Jackson County, Missouri,
together with some adjoining lands, all being known as the Hollaway
Farms
That this affian and William H. Wallace were brothers and
practiced law together as partners from the year 1885 up to the time
William H. Wallace retired from the law business, a few years before
his death which accurred in October 1937.
That the affian1 was familiar with all the business affairs of
William H. Wallace, who consulted with the affiant concerning the
same, and the affiant often attended to some of his personal business.
That the affiant remembers the purchase of the Hollaway farm by
his brothers, william H. Wallace and John C. Wallace, in the year of
1883, but does not remember the exact date of the deed except by
reference to the Abstract of Title.
That the affiant always has been familiar with the possession
and location of this farm, having been brought up on a neighboring
farm. That the affiant remembers the sale by John C. Wallace and William
H, Wallace of an undivided one-third interest to L. H. Willis of
Nicholasville, Kentucky, and the re-purchase from Willis of the
Willis one-third interest in 1891, The affiant having been consulted
about the re-purchase.
And, the affiant remembers very well the sale and conveyance by
John C. Wallace to William H. Wallace of one-third interest, which
was a short time before the death of John C. Wallace.
The affiant has always been familiar with the possession and
occupancy of the Hollaway Farm by William H. Wallace, and knows
of his own knowledge that William H. Wallace has been in actual
possession of said lands and every part thereof since he acquired the
full title in 1891 up to the time of his death in 1937, claiming
title thereto under the deeds from the Hollaway heirs; John C.
Wallace and L. H. Willis farming and improving the land and making
extensive improvements there. That such possession has been actual,
open, notorious and continuous under a claim of ownership, adverse
to any and all other persons.
