-13- the published and unpublished works of the Allied Powers and their nationals have continued in force since that date, and recognizes those rights which have arisen, or but for the war would have arisen, in Japan since that date, by the operation of any conventions and agreements to which Japan was a party on that date, irrespective of whether or not such conventions or agreements were abrogated or sus- pended upon or since the outbreak of war by the domestic law of Japan or of the Allied Power concerned. (ii) Without the need for application by the proprietor of the right and without the payment of any fee or compliance with any other formality, the period from the 7th December, 1941, until the coming into force of the present Treaty, shall be excluded from the running of the normal term of such rights; and such period, with an additional period of 6 months, shall be excluded from the time within which a literary work must be translated into Japanese in order to obtain translating rights in Japan. (Note: Paragraph (a) of this Article is dependent upon the acceptability of the legislation to be passed by Japan. Paragraph (b) assumes that an extension of time until September 30th, 1951, can be obtained for filing applications under the Cabinet Orders concerned.) Article 16. As an expression of its desire to indemnify those members of the armed forces of the Allied Powers who suffered undue hardships while prisoners of war of Japan, Japan will transfer its assets and those of its nationals in countries which were neutral during the war, or which were at war with any of the Allied Powers, to the International Red Cross which shall liquidatc such assets and distribute the resultant fund for the benefit of former prisoners of war and their families on such basis as it may determine to be equitable. Note: The status of Japanese assets in Thailand is subject to further consideration, /Article 17.
