My dear Mr. Latta:
On November 19, 1945, you advised this office that H.R. 391, "To
amend section 342 (b) of the Nationality Act of 1940, " had been re-
ceived at the White House and requested reports and recommendations
as to the approval of the bill.
Section 342(b) of the Nationality Act of 1940 fixes fees to be
charged by the Commissioner of Immigration and Naturalization for
various services, including a fee of $1.00 for an application for a
duplicate declaration of intention or for a certificate of naturaliza-
tion if the original has been lost, mutiliated, or destroyed.
The Act of April 19, 1934 (48 Stat. 597) granted a waiver of the
fees in question on behalf of veterans as defined in section 1 of the
Act of May 28, 1926 (44 Stat. 654).
This exemption was repealed by Section 504 of the Nationality
Act of 1940 (54 Stat. 1173), and therefore, under existing law, a
veteran is of necessity required to pay the fee in question.
The bill would reinstate the veterans' exemption contained in
the 1934 Act and at the same time extend it to veterans of the
present war, the Spanish American War, the Philippine Insurrection,
and the Campaign on the Mexican border.
A facsimile of the enrolled enactment has been referred to the
State Department and the Department of Justice, and the ir replies,
either recommending approval of the bill or interposing no objection
to its approval, are attached.
I am authorized by the Director of the Bureau of the Budget to
recommend that the bill be approved.
