spain DEPARTMENT OF STATE WASHINGTON 2310 February 12, 1970 SECRET MEMORANDUM FOR THE PRESIDENT SUBJECT: Waiver Determination to Permit Grant Military Assistance Program to Spain The enclosed memorandum recommends that under Section 614 (a) of the Foreign Assistance Act you determine that the authorization of $50 million to provide military assistance to Spain is important to the security of the U.S. and that you authorize the use of such sum for that purpose. Without such a determination and authorization assistance to Spain would be prohibited by Section 620 (m) of the Foreign Assistance Act which provides that "No assistance shall be furnished on a grant basis under this Act to any economically developed nation capable of sustain- ing its own defense burden and economic growth " This is the first Section 614 (a) waiver determination requested in the case of Spain. Your determination will permit fulfillment of intentions expressed by the United States Government in connection with the Agreement signed on June 20, 1969, to extend the Defense Agreements of 1953 from September 26, 1968, until September 26, 1970. This agreement provides for continued military rights and use of facilities in Spain. As part of the quid pro quo for the extension, the United States Government indicated its intention, subject to the existence of authorizing legislation and to the provision of the necessary funds by Congress, to provide up to a maximum of $50 million of military assistance during the period of the extension.
