THE PRESIDENT HAS SEEN day NEWS SUMMARY September 29, 1973 (Friday nets, wires, papers) The major stories of the day: -- VP lawyers filed suit to block grand jury investigation on grounds he's constitutionally immune fromindictment while still VP. Led all nets w/note (ABC/NBC film) that Petersen and VP attys. met w/Judge Walter Hoffman in Norfolk to discuss motion. He said GJ can proceed pending his ruling which will follow submission of all briefs by Oct. 12. Kiker noted indictment could be returned before then. (Hoffman was appointed when all 9 Md. judges disqualified selves.) VP attys also charged prosecutors "have engaged in a steady campaign of statements to press which have no purpose and effect other than to prejudice" any GJ hearing and that this was deliberate effort w/in Justice to force Veep from office. Justice responded w/what Chancellor called "strong language" about a VP as Dept. said the charges were "patently ridiculous. " VP's motion said US "mustn't be deprived of his services' 11 while he fights indictment voted by "perhaps 12 of 23 jurors/on or info filed at the whim of a prosecutor. 11 Brief said VP "must hold the office and be free to perform its duties til his removal comes about in accordance w/constitutional plan by impeachment, resignation or expiration of his term." Clips on all nets as a casually-dressed VP flew to Calif. for what's expected to be "powerful" speech to GOP women. Live NBC coverage at 1:30 PM Sat. Nets all noted he was staying at Sinatra's JBC on CBS/NBC film in what Mackin called a "major blunder' as he told GOP women that "I, like you, hope and pray the facts are such that VP is completely exonerated and that he's indeed found guilty and all of us can admire the fighting spirit he mani- fests at every turn. " Nets added that JBC later told reporters, "I want to apologize to you and certainly to VP. " Noting JBC's "very generous' support of Veep, Mackin said he can afford to be, as every day, chances look better that GOP will turn to him to lead it out of trouble.
