Dear Mr. Roeder,
RADIUM CORP.
Receipt is acknowledged of your letter of the 9th
inst. We note that you have received Dr. Gilman Thompson's
report and transmitted it to Mr. McGlynn. We also note that
you have advised Mr. Veidt of recommendations made by Dr.
Thompson concerning operations at the plant and have asked
him to immediately put such recommendations into effect.
While this is perhaps the best course to adopt, it is possible
that the fact that you have made such changes may be used
against you at the trial as an indication that the methods
previously employed by you did not afford your employees ade-
quate protection.
I note your inquiry concerning the advisability of
explaining the situation to your customers who have applica-
tion plants. I believe that it will be advisable to send a
letter of explanation to them. In fact you have a duty to
warn them of the dangers inherent in the application of the
paint sold by you if you know of such dangers. It does not
seem to me that the time is yet ripe for such a letter. I

would advise waiting until the investigation conducted by
Dr. Gilman Thompson and Dr. Field has made further progress.
The question is a serious one and may involve great risk
by your company and I think that we should have all of the
available information on the subject before attempting to
deal with it.
I note your statement that the State Department
of Health desires a copy of Dr. Drinker's report and also
note that you will refer them to me. This is the proper
course to adopt. I assume that any inquiries concerning
reports of experts or which in any way relate to the pend-
ing case or to possible claims of former employees will be
referred to me. I am inclined to believe that it would be
advisable for you to communicate directly with me with
regard to all matters connected with this case and I can in
turn communicate with Mr. McGlynn. If this method is fol-
lowed, I will be kept advised as to every step that is taken.
I notice in Dr. Drinker's report that he refers to
a possible publication of the results secured by him. His
APR 13 1925
statement is as follows:
"It is a pleasure to acknowledge this co-operation
sure
in a thorough examination which, when coupled with
publication of the results, confronts the medical
profession with a most interesting and novel pro-
blem."
UNITED STATE
This leads me to fear that the Doctor may be contemplating
RADIUM 0081
publishing his report. It would be exceedingly dangerous to

have such publication occur at this time. I assume that Dr.
Drinker was retained on a basis which makes his employment
confidential, and which would preclude him from publishing
his report or advising others of the results which he se-
cured. If you do not know what Dr. Drinker's intentions in
this matter may be, I would suggest that you have an inter-
view with him as soon as possible.
