Dear Mr. Barker:
Replying to your letter of the 3rd, please
be advised that in all likelihood this case will not be tried
until the Fall of the year. The argument of the question
whether or not the defense of the statute of limitations
is good is going to consume a lot of time. Mr. Winans, the
attorney for the plaintiff is ill. He is in the hospital
now. Whether or not this argument will be held on the 16th
is doubtful. Even if it is, the court will undoubtedly re-
serve decision. We are therefore not in any position to
advise Dr. Schlundt that the trial of the action will take
place in April. All we can do is to have a time fixed far
enough off, when it is fixed, so that we can arrange for
Dr. Schlundt and Dr. Lind, if possible.
