H.R. 11016 - Renegotiation Act Extension
Attached for your consideration is H.R. 11016, sponsored
by Representative Minish and thirteen others, which
would extend the Renegotiation Act of 1951 through
September 30, 1976. The Act is due to expire on December
31, 1975, and this nine-month extension will allow the
Congress additional time to consider the Administration's
legislation to extend the Act for five years and to make
a number of substantive changes in the Board's authorities.
Additional information is provided in OMB's enrolled bill
report at Tab A.
OMB, Max Friedersdorf, Counsel's Office (Lazarus) and I
recommend approval of the enrolled bill.
RECOMMENDATION

The Renegotiation Act of 1951 provides for the review by the
Renegotiation Board of total profits derived from Federal
defense and space-related contracts if a contractor's total
renegotiable sales exceed $1 million annually. If the Board
determines, in accordance with certain statutory criteria,
that a contractor's profits are excessive, it is empowered
to return those profits to the Federal Government. The Act
is due to expire on December 31, 1975.
The enrolled bill would extend the Act for nine months through
September 30, 1976.
The Administration has submitted legislation to the Congress
to extend the Renegotiation Act for five years and to make
a number of substantive changes in the Board's authorities.

No final action has yet been taken by the Congress on this
proposal. The Renegotiation Act must be extended until
action on the pending legislation has been completed since,
under existing law, defense and space-related contracts
entered into after December 31, 1975, are not subject to
renegotiation.

Dear Mr. Frey:
Reference is made to your memorandum dated December
19, 1975 requesting the Renegotiation Board's views
and recommendations on enrolled bill H.R. 11016.
The Board approves this bill which would extend the
applicability of the Renegotiation Act of 1951, as
amended, to September 30, 1976. The Renegotiation
Act of 1951, as amended, is due to expire December 31,
1975 and this nine-month extension will allow Congress
the additional time it needs to complete its work on
a comprehensive review to strengthen and reinvigorate
the renegotiation process.
It is therefore recommended that the President sign
the bill.

To extend the Renegotiation Act of 1951 for nine months.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled, That section 102(c)
(1) of the Renegotiation Act of 1951 is amended by striking out
"December 31, 1975" and inserting in lieu thereof "September 30, 1976".
