KNOW ALL MEN BY THESE PRESENTS, That we, George Noland and Ella P.
Noland, his wife, of the County of Jackson and State of Missouri, for
and in consideration of $1.00 or of other valuable considerations in
hand paid by Robert R. Choplin and Mabel P. Choplin, the receipt whereof
is hereby acknowledged, do hereby grant and demise to said Robert R.
Choplin and Mabel P. Choplin, their successors and assigns, a right of
way to lay pipe for the transportation of water and to operate and
maintain the same, in and through certain real estate in the County of
Jackson and state of Missouri, described as follows, to-wit: Beginning
of
12 feet north of the southwest corner of that portion of Lot 3 Fogle
Estate lying east of B lue Ridge Boulevard and south of 27th Street
running thence east 217.3 feet together with all the rights and privileges
incident and necessary to the enjoyment of thi S grant.
We do also grant to Independence Water Company, its successors and
assigns, the right to construct, maintain and operate a valve box or
manhole at a point 145 feet east and one 217.3 feet/of beginning.
In further consideration of said grant and demise, said Robert R.
Choplin and Mabel P. Choplin by the acceptance thereof agrees to bury
said pipe at least 42 inches below the surface of the ground, and
grantees or their successors hereby agree to maintain that portion of
the line east of meter well located 145 feet east of beginning of said
described line. If damages should occur to premises traversed by said
line and same could not be ascertained by the parties hereto or their
successors same to be determined by three (3) disinterested persons on
oath, one thereof to be appointed by the undersigned or their successors,
one by the said Independence Water Company, and the thirdyby the two so
appointed as aforesaid, and the award of such three persons shall be
final and conclusive,
IN WITNESS WHEREOF, we have hereunto set our hands and seals this
28th day of September, 1938.
