Dear Admiral Land:
This acknowledges your letter of December 6, 1945, relating
to disposal of vessels outside continental United States.
You recommend that we designate State Department as the
disposal ageney for "all commercial vessels or vessels capable of
conversion to merchant vessels located outside the continental limits
of the United States except (a) ships built under the Merchant Marine
Act, 1936, and (b) ships covered by the Ship Sales Bill.
Under the Surplus Property Act of 1944 considerations arise
with regard to vessels located within the limits of the Territories
and possessions which are different from those relating to vessels
in foreign areas. We, therefors, will segregate these problems in
discussing your recommendation.
Torritories and Possessions.
Section 10(b) of the Surplus Property Act requires that
the Maritime Commission be the "sole disposal agency for surplus
vessels which the Commission determines to be merchant vessels or
capable of conversion to merchant use." We do not see how we can
disregard this provision; we cannot do so under Section 32(b) of
the Act because any exemption possible under that Section is confined
to #dispesitions of property located outside the continental United
States, its territories and possessions." We are unable, therefore,
to name any other agency as the disposal agency for such vessels in
the territories and possessions.
If the Maritine Commission determines that only ships built
under the Merchant Marine Act, 1936, and ships covered by the Ship
Sales Bill are "merchant vessels or sapable of conversion to merchant
use," then all other vessels in the territories and possessions would
be handled by the Department of the Interior as SPA Regulation 1 now
stands. No change is required in our Regulation to relieve the Maritine
Commission of any disposal responsibility there which is not required
by the Surplus Property Act.
It appears, therefore, that no action is required on our
part with regard to vessels assigned to the Maritime Commission for
disposal in the territories and possessions. The extent of the
responsibilities of the Commission is solely a question for the
Commission to decide by its deternination as to what vessels are
merchant vessels or convertible to merchant use.
