I'm thinking in terms of intellectual competence. P - Oh, well, sure. C - I'm thinking of an appellate kind of mind. I say it takes more brains to be a District Court Judge than it does to be a Court of Appeals Judge because you have to do the original filtering of things. P - It takes a different kind of brains. C - But it takes a different kind of brains, and it needs somebody who's been in an administrative job and then we also get rid of the HOLTZOFF threat. P - Who's pushing MATT? C - I don't know. P - That's a strange thing. I never thought he had much backing after BOB JACKSON (Supreme Court) and so forth left. I mean--that's more the old (HUGH) CUMMINGS (former Attorney General) business. I don't know. I just couldn't figure what was--JOHN McCORMICK? (Majority House Floor Leader ?) C - Well, I don't know. I suppose so. I don't want to hurt MATT--he's a nice guy. But I mean, I'm thinking of something else. P - I like MATT all right, but MATT has got about as much sense of appellate law as C - Well, it's a different kind of law and what I want to do is--I mean, I want to see things--and I think MATT means HOLTZOFF too. I mean, all around, anyway you take it--Catholics, Jews, appellate juris- diction, original court jurisdiction, anything--and this PROCTOR business is bad, boy. Absolutely unnecessary. Republicans don't appoint Democrats. Why Democrats have to show they've got a fundamental inferiority complex so they have to appoint Republicans so the country will think they're respectable, and that's what it all is, fellow, I think is nuts! P - That's right. C - But I'm saying you're going to have a rotten court if you don't move. P - That's right. C - I tell you a fellow who could help you with ABE too is LYNDON (JOHNSON ?). P - LYNDON's still in Texas. C - Well, he's on the other end of a telephone. P - Yeah, but I don't know who LYNDON-- C - LYNDON would be for ABE. P - Yeah, but I just don't know how much influence held have. C - I think he has a great deal. P - Well, I'll call him. C - O.K., sir. P - All right. Thanks, TOM.
