TOM the fill up on some developments and asks his advice. JOE will

TOM CORCORAN talked to BILL BATLEY in Senator GUFFEY's office. BILL
reads to TOM the following letter which GUFFEY received last Saturday
from (WELCH) POGUE, Chairman of CAB. (This letter was later dictated
to Mrs. BEHAN, in CORCORAN's office, so that CORCORAN would have the
complete text. The letter is as follows:
"
October 12, 1945
Honorable JOSEPH F. GUFFEY
United States Senate
Washington, D. C.
Dear Senator GUFFEY:
"We have your letter of September 24th with respect to the request of
Senator PEPPER to participate as tamicus curiae' when the rehearing
of the petition of Pennsylvania Central and other companies of the
Great Lakes-to-Florida air route case is held.
"There are pending before the Board at the present time, in addition
to petitions filed by Pennsylvania Central and National Airlines, a
number of petitions by interested cities seeking reconsideration, re-
hearing and re-argument of the Board's decision in the Great Lakes-
Florida case.
"Under the Board's procedure, these petitions will be carefully con-
sidered, and, if sufficient grounds have been shown to justify a
re-opening of the proceedings, it will doubtless be assigned for
further hearing or for re-argument before the Board. If the case
is re-opened and further argument is to be presented, the Senator's
request for an opportunity to present his views with respect to the
case will, of course, receive careful consideration. In view of his
absence from the country, if a further argument is to be held, it
will not be assigned until after his return.
