JUL 2 8 1945 My dear Mr. Latta: The Congress has enacted H.R. 169, "To amend section 8 of the Act entitled 'An Act to amend the Act entitled "An Act to provide that the United States shall aid the States in the construction of rural post roads, and for other purposes, " approved July 11, 1916, as amended and supplemented, and for other purposes, approved July 13, 1943." It is the purpose of the bill to amend section 8 of the Act approved July 13, 1943 (57 State. 562) which latter act was an amendment of previous legislation first enacted in 1937 for the purpose of aiding the States in making or for having made certain toll bridges free. The measure under consideration changes the provisions of section 8 as ap- proved on July 13, 1943 in the following principal respects (1) by eliminating the requirement that before any bridge shall be eligible for the Federal aid provided in section 8, the Secretary of War and the Secretary of the Navy should certify that to make it free would contribute to the war effort; (2) to elimi- nate from the prior enactment a provision authorizing the Federal Government to acquire toll bridges and make them free when it should be found that the States or their subdivisions could not acquire them by condemnation with sufficient promptness; (3) the bill contains a new limitation on the extent of reimbursement that the Federal Government may make on account of the freeing of any bridges by providing that where a bridge was constructed with the aid of Federal funds or with the aid of a grant from the Federal Government, the amount of the Federal funds so expended shall be deducted before computing the Federal share under the terms of the bill. A facsimile of the enrolled enactment has been referred to the Federal Works Agency and its reply recommending approval of the bill is attached. The report of the Federal Works Agency indicates that at this time there is only one bridge, namely the bridge located across the Missouri River at Washing- ton, Missouri which may be made free pursuant to the terms of the bill.
