Dear Mr. Stryker:
Your letter of the 20th leads me to believe that there is
some misunderstanding between Mr. McGlynn and his Company because when
the Insurance Company accepted the defense of the suit it was clearly
stated that they would pay the cost in preparation. Mr. McGlynn
asked us for help in selecting medical authorities, and lir. Tams,
Mr. Lee and I went with Mr. MeGlynn to see Dr. (11man Thompson.
Thompson reconmended Dr. Flinn and we have been cooperating with Dr. Flinn
since.
However, it was clearly on Mr. McGlynn's mathority and
instruction to us that we retain Dr. Plinn.
Regardless of the first item, it seems to me that the
Company is setting a very low estimate on the probable cost of defense
and ensuing appeal if one is talcen.
In view of the discrepancy between their understanding and
ours, it seems best that we should confer on the subject promptly.
Mr. Lee and I will axrange to meet at the convenience of the others.
I see no reason for deferring "brass tacks" negotiations
between MeGlynn and Kalisch so that we can come to a decision.
Of course all of the cases should be treated as a whole.
