Pesinger, Esq. 2 opinion tha t this is olearly radium poisoning, the question will arise whether or not you wish to have the radium company con- sider the question of settlement under the understanding arrived at in the Tuck case. That understanding was that the Radium Company could settle (the amount to be approved by the insurance ampanies) with the agreement that if the Tuck case should be decided in favor of the Radium Company that then the insurance companies would reimburse the United States Radium Company. The two questions to be presented in the Tuck ca.se are, first whether or not there is any coverage, and second, the pro rate share to be paid by each insurance company.
