STATE OF NEW JERSEY : HOWARD H. BARKER, of full age, being duly sworn according to law on his oath, deposes and says: 1. I am Vice President and Secretary of the de- fendant corporation and have been connected with said defendant since the year 1923. 2. The President of the defendent corporation is C. B. Lee, who is also Treasurer and he has been connected with the defendant since about 1922. 3. The said Lee and myself are the only officers of the defendant corporation. 4. Neither of us have any personal knowledge as to the answers to the interrogatories of the plaintiff dated November 9, 1933 which were sustained by Judge Fake and ordered answered by him and there is no other officer of the company who has any such personal knowledge. Therefore it is impossible for any officer of the defendant corporation to answer said interrogatories. Subscribed and sworn to ; at Jersey City, N.
