United States Radium Corporation. - Leonard J. Emmerglick, Lefeourt-Newark Building, Newark, N. J. Dear Mr. This letter reiterates our telephonic understanding of yesterday, via: that we are not to go ahead with the trial of the above equity case on September 17th, but that on the contrary, it is to go over until October 15th. I have comunicated with Mr. Havens, Clerk of Judge Forman's Court, who informs me that he cannot reach Judge Formen et this time because he is on his way back from Colifornia and Mr. Havens does not know just where he will be at any given time. Judge Formon will return to Trenton on September 10th and will be present at the opening of the Federal Court at Trenton on September lith. Mr. Havene advises mes however, that he has no doubt that Judge Forman will respect our agreement because he has plenty of other work to do and since he will roturn on September 10th, he will be able to make arrengements to hear aome other case on the 17th. I ell, therefore, oelling off all of our witnesses and making arrangenents now to get ready for the 15th of October. I am sending a copy of this letter to Juâge Forman, Mr. Havens, Mr. Edward r. Smith, my associate, and Mr. Barker, Viee President of the United States Radium Corporation. Very truly yours, EDWARD A. MARKLEY EAM:LB
