RE: LaPorte vs. United States Radium
Corporation.

Dear Mr. Emmerglick:-
This letter reiterates our
telephonic understanding of yesterday, viz: that we are
not to & ahead with the trial of the above equity case
on September 17th, but that on the contrery, it is to go
over until October 15th. I have communicated with Mr.
Havens, Clerk of Judge Forman's Court, who informs me
that he cannot reach Judge Forman at this time because he
is on his way back from California end Mr. Havens does not
know just where he will be at any given time. Judge Forman
will return to Trenton on September 10th and will be present
at the opening of the Federal Court at Trenton on September
11th. Mr. Havens advises me, however, that he has no doubt
that Judge Forman will respect our agreement because he has
plenty of other work to do and since he will return on
September 10th, he will be able to make arrangements to
hear some other case on the 17th. I am, therefore, celling
off all of our witnesses and making arrangements now to get
ready for the 15th of October.
I am sending a copy of this
letter to Judge Forman, Mr. Havens, Mr. Edward F. Smith,
my associate, and Mr. Berker, Vice President of the United
States Radium Corporation.
