My dear Mr. Latta:
On September 18, 1945, you advi sed this office that H. R. 999,
"For the relief of Lily L. Carren, "f had been received at the Whi te
House, and requested reports and recommendations as to the approval of
the bill.
It is the purpose of the bill to pay the sum of $3,500 to Lily L.
Carren of Hayward, California, in settlement of her claims against the
Uni ted States by reason of personal injuries and property damage sustained
as a result of having been struck by a Navy Shore Patrol station wagon on
November 6, 1943, at a street intersection in Hayward, California.
It appears that on the date in question, the claimant, while cross-
ing a street intersection in the marked crosswalk in Hayward, California,
was struck by a Navy vehicle which had turned into the street she was
crossing and which, although going at a low rate of speed, was apparently
unable to stop because of defective brakes.
As a result of the accident, the claimant sustained an injury to
her spine and chest. An exray examination indicates that there is an en-
largement of the left side of her heart and a calci fi cation of the pul-
monary vessels. The claimant was 39 years of age at the time of the
accident. She obviously suffered a rather severe nervous and physi cal
shock, and, apparently, has not fully recovered from the injuries. The
claimant sustained some clothing injury and loss of earnings which, to-
gether with medical and hospital expenses, aggregate an amount of $1,226,
and leaving a balance of $2,274 for personal injuries sustained and the
pain and suffering in connection therewith.
A facsimile of the enrolled enactment has been r eferred to the Navy
Department, and its reply, interposing no objection to the approval of the
bill, is attached. There appears to be no question but what the accident
in question was due to the fact that the brakes on the Government vehicle
were defective and that the driver, knowing that to be true, should have
had the vehicle under more complete control at the street intersection.
