My dear Mr. Latta:
On July 27, 1946, you advised this office that S. 1880, "For the
relief of the Crosby Yacht Building and Storage Company, Incorporated,"
had been received at the White House and requested reports and recommenda-
tions as to the approval of the bill.
It is the purpose of the bill to pay the sum of $2,238.27 to the
Crosby Yacht Building and Storage Company, Incorporated, of Osterville,
Massachusetts, in settlement of its claim against the United States for
work performed by it in the removal of certain boats from temporary
shelters and in the removal of such shelters, pursuant to an agreement
entered into by the company with the Engineer Amphibian Command,
Camp Edwards, Massachusetts, on or about July 2, 1942.
It appears that at the request of the Engineer Amphibian Command
and the office of the division engineer, New England division, the
claimant company granted to the United States an immediate right of
entry on certain lands and buildings owned by the company in Osterville,
Massachusetts; that an agreement was executed whereby said company
leased its premises at Osterville to the United States; that at the
time of this lease certain boats which had been stored by private owners
under contract with the company occupied a part of a large boat shed
which the Government wished to use; that in order to make this space
available to the Government, it was necessary to remove the boats to
nearby vacant land owned by the company and to build temporary shelters
there to house the boats; that the company endeavored to include in its
lease of its premises to the Government a provision whereby the Government
would agree to pay the expenses incident to the removal and rehousing of
the boats, and also the expenses which would be involved in the dismantling
of the temporary boat shelters and the return of the boats to their
original location in the company's boat shed upon the termination of the
Government's lease of the premises, but the company was informed by agents
of the Government that this matter would have to be taken care of by a
separate agreement; and that an oral agreement or understanding was
entered into between the claimant company and the representatives of the
Government whereby the Government would bear such expenses. The payment
proposed by the bill represents the actual expense incurred in removing
the boats, storing them in the temporary shelters, and replacing them in
their former location after termination of the lease.
