2 ligated funds under this section otherwise payable to that

(c) NON-PARTICIPATING STATES LICENSING RE-
5 QUIREMENTS.-For retailers in States which have not es-
6 tablished a licensing program under subsection (a), the
7 Secretary may promulgate regulations establishing a Fed-
8 eral retail licensing program for retailers engaged in to-
9 bacco sales to consumers in those States. The Secretary
10 may enter into agreements with States for the enforce-
11 ment of those regulations. A State that enters into such
12 an agreement shall receive a grant under this section to
13 reimburse it for costs incurred in carrying out that agree-
14 ment.
