S:\WPSHR\LEGCNSL\XYWRITE\CONSUMER\TABAC4 141 1 taking, the Secretary may withhold a portion of any unob- 2 ligated funds under this section otherwise payable to that 3 State. 4 (c) NON-PARTICIPATING STATES LICENSING RE- 5 QUIREMENTS.-For retailers in States which have not es- 6 tablished a licensing program under subsection (a), the 7 Secretary may promulgate regulations establishing a Fed- 8 eral retail licensing program for retailers engaged in to- 9 bacco sales to consumers in those States. The Secretary 10 may enter into agreements with States for the enforce- 11 ment of those regulations. A State that enters into such 12 an agreement shall receive a grant under this section to 13 reimburse it for costs incurred in carrying out that agree- 14 ment. 15 TITLE III-TOBACCO PRODUCT 16 WARNINGS AND SMOKE CON- 17 STITUENT DISCLOSURE 18 Subtitle A-Product Warnings, 19 Labeling and Packaging 20 SEC. 301.
