We have reviewed the attached binder on Presidential succession.
In addition to providing the draft letters called for at Appendices
8 and 10, we have made two substantive changes.
First, the discussion of the oath required by the Vice President
or the Speaker upon assuming the Presidency, Tabs A and F
respectively, has been changed. The earlier discussion stated that
5 U.S.C. § 2904 (c) required that the oath be administered by a
competent official acting within the United States or a territory
or possession of the United States. Not only did this discussion
reference the incorrect section -- it is § 2903 (c) -- we have
determined that § 2903 (c) does not apply to the oath for the Office
of the Presidency. The Vice President or Speaker, even if he is
away from the United States, may simply swear the oath although
considerations of decorum would probably suggest that an appropriate
official perform the act. The crucial consideration is that the
Vice President or the Speaker does not have to wait to return to
the United States to swear the oath.
Second, we have added a cautionary paragraph to the discussion of
the procedures of the Twenty-Fifth Amendment contained at Tab B.
At page 3 of that discussion we have included the paragraph:
Consideration should always be given to whether
the procedures of the 25th Amendment need to be
activated. If the President's disability will be
brief and it is doubtful that any of his non-
delegable powers will have to be exercised, it may
be preferable not to employ the elaborate and
untested procedures of Section 3.
This caution reflects our belief that Section 3 need not be used
whenever a President undergoes a brief period of disability such as
surgery. Quick resort to Section 3 may establish precedent that
will be difficult to avoid in future years when a President would
prefer not to pass power -- however briefly -- to a Vice President.

Alumni Newsletter Article
Charles Heatherly, Director of the President's Commission on
White House Fellowships, has asked for your views on a book
review tentatively slated to be published in the Alumni
Newsletter. The review, which lists no author, is of
Lincoln Caplan's The Insanity Defense and the Trial of John
W. Hinckley, Jr. (The review was apparently written by a
part-time employee of the Commission, Denise Liebowitz.)
Caplan was a White House Fellow with the 1979-1980 class.
The review notes that the Hinckley acquittal prompted calls
for reform of the insanity defense by William French Smith
and Edwin Meese, but that Caplan questions the need for any
reform "in a highly sensitive and comprehensive fashion."
The review of the book is a very favorable one, containing
no critical analysis of Caplan's positions. For example,
the review notes that Caplan documents how infrequently the
insanity plea is invoked, and how rarely it is successful,
but does not note that, even rarely invoked, the plea
imposes staggering costs on the judicial system and, since
it is often invoked in celebrated cases, has an effect on
public confidence in the law far out of proportion to the
number of cases in which it figures. The book is clearly at
odds with Administration policy in this area, and the
review, since it is so favorable, could be considered to be
so as well.
The attached memorandum for Heatherly notes that the White
House does not want to get into the business of reviewing
the Alumni Newsletter for consistency with Administration
policy, and suggests that the surest way of according
prominence to the book and the review would be to attempt to
block the review. (The memorandum also advises Heatherly
not to use "confidential" on his memoranda.)

U.S. Holocaust Memorial Council
You have asked for our views on a request from Barry Fisher
that the President "by Presidential directive create an
associate status for three or four members of the Gypsy
community leadership which would give them an ex-officio
status with the Council allowing them of right of access to
all privileges of that body." As you know, the Council is a
creature of statute. The methods of appointing its member-
ship, Executive Director, employees, experts, and consultants
are all fixed by law. See 36 U.S.C. §§ 1401-1405. Under
these circumstances it would be inappropriate for the
President to attempt to interfere with the legislative
scheme for the Council by unilaterally creating a new class
of offices associated with the Council and according that
new class rights with respect to the Council's activities.
The appropriate course for Mr. Fisher to pursue would seem
to be to encourage the appointment as members of the Council
of individuals who share his concerns about representation
of the Gypsy community in the Holocaust Memorial.

Attached is correspondence from Barry Fisher regarding the United
States Holocaust Memorial Council. Fisher requests that the
White House "by Presidential directive create an associate status
for three or four members of the Gypsy community leadership which
would give them an ex-officio status with the Council allowing
them of right access to all privileges of that body." My reading
of the relevant statute suggests that no White House discretion
exists to create new classifications of Council membership. The
Council itself may have such discretion.
Can you please confirm the legal position so that I might respond
to Mr. Fisher.

Dear Mr. Valente:
We are at that season when the 40th anniversary of the
"liberation" of Auschwitz is being observed. And it brings to
mind an historic injustice that is within the power of our
society to correct at least as far as the American public and
the American government are concerned. Among the victims of the
Nazi carnage were approximately 1/2 million Gypsies who were
treated to the same holocaust victimization that Jews were
subject to on grounds not dissimilar and in conditions largely
identical.
It is tragic that no real recognition has been given to
the eradication of a large part of this historic people. It is
also important that the Gypsies of various religious cultural
and national backgrounds can come together and in a unity to
honor their common dead whose sole cause for death was their
being of Gypsy background and descent.
The creation of a place on the United States Holocaust
Memorial Council for Gypsy representation would be a significant
step in the right direction of correcting an historic omission.
The present commission consists, we believe, of sixty-six
members who serve by presidential appointment and at the
discretion of the President. To the best of our knowledge,
there are no current vacancies.
We therefore urge that the White House, by presidential
directive, create an associate status for 3 or 4 members of the
Gypsy community leadership which would give them an ex-officio
status with the Commission, allowing them of right access to all
privileges of that body, except for voting, and with a kind of a
priority for filling what places may eventuate in the course of
time when vacancies occur on the commission.

We also believe that it would be of significant value to
both the administration in its desire to serve all people with
all backgrounds in the nation, as well as to furthering the
unifying goals which are set by Gypsy leadership from various
subgroups on the American scene if the President of the United
States would create a photo opportunity and be photographed with
some of the leadership.
Certainly this would be status-giving to the Gypsies and
would provide the proper news setting for the announcement for
the associate ex-officio appointments of Gypsies to the
commission.
The signators of this letter are not Gypsies but were
among those who were present in a semi-professional and yet
largely personal capacity at the founding meeting of the United
States Romani Holocaust Council which was held, interestingly,
at the auspices of the Simon Weisenthal Center at Yeshiva
University of Los Angeles.
Both writers, being Jewish, understand that somehow or
other it will be redemptive of a measure of the sorrow of the
tragedy for the Gypsies to experience that same memorializing
that Jews do in Jewish holocaust observance. Further, we note
how the Holocaust has been, tragically enough, a unifying factor
in bringing Jews together with common memories that make for
elements of a common present and hopefully a more unified future.
This same social and spiritual change can come with
significance to the Gypsies of America, and through them,
perhaps by extensive to Gypsies throughout the world. If the
President of the United States will help create an initiative so
that another historic injustice can be met with a response of
dignity, then something of the evil of the past can be translated
into a good for the present and the future as a memorial and as
a warning for all times. Gypsies should be part of the "Days of
Rememberance" observance nationally sponsored by the Commission.
We hope that this will elicit from you a sense of an
historic commitment. One of the signators of this letter,
attorney Barry Fisher, has spoken to you about his being in
Washington on Friday, February 14, and would look forward to the
opportunity of meeting with you at a time of mutual convenience
if it can be arranged. Please phone to let him know whether
this can be arranged. He may be in Washington on Thursday and
will remain until Sunday.

Recently 130 student members of the "Up With People" group
toured the White House and posed for a "class picture" on
the front lawn, taken by an accompanying photographer. The
photographer suggested to Billie Shaddix that the group
would greatly appreciate receiving prints of the photograph
signed by the President.
"Up With People" is a 501 (c) (3) organization dedicated to
promoting international understanding and goodwill. Groups
of students associated with the organization tour the
country and the world giving uplifting musical performances.
I have no legal objection to the President signing the
photographs for the students.

Dear Billie,
I have a suggestion whereby President Reagan
can "make the day" for 130 outstanding young students and
one of America's most successful corporations in one gesture.
Here's how:
Last month I photographed the amazing "Up With
People" program for the Honeywell Corporation during the
troupe's Washington tour on behalf of Honeywell's 100th
Anniversary Celebration. I've enclosed some literature on
"Up With People" to explain who they are and why this
program for young people is S0 worthy of your attention.
Part of the stay for 130 members of the cast
included a White House tour, and, at the end of the tour,
I made a "team" photo on the front lawn.
I'd like to suggest that were the White House
to provide 130 color photos of this team picture signed by
President Reagan, it would provide the "frosting" on what
many of the students consider their very best stop on
their world-wide trek.
I have no further connection to either "Up
With People", or Honeywell. But, after looking at the
group photo I made of the kids and seeing how trully
happy they all were to be at the White House, I couldn't
help but think of the joy they all would have at
receiving a signed photo commemorating their trip.
Enough said! I have the transparency for you
to see if you need it, and I can give you some more details
should you require it. Honeywell plans to send the troupe
a small package of clips and other memorabilia at one
of their stops in the "85 tour. The President's picture,
can be included.

Thank you for your letter of April 9 to the President. In
that letter you related your experiences with Digistat. You
also enclosed a copy of Digistat promotional material
prominently featuring a letter from the President congratu-
lating Robert Michaud, President of American Stabilis, Inc.,
and nine other individuals who were chosen by the United
States Jaycees as the Ten Outstanding Young Men of 1983.
The White House was totally unaware of the misuse of the
letter from the President and the President's name in the
Digistat advertisement. The White House adheres strictly to
a policy of not permitting any use of the President's name,
likeness, photograph, or signature in any way that suggests
or could be construed as endorsement of a commercial product
or enterprise. The advertisement you forwarded to us
clearly contravenes this policy, and accordingly I have
written Mr. Michaud objecting to the advertisement and
advising him to cease immediately this misuse of the letter
and the President's name. I have enclosed for your informa-
tion a copy of my letter to Mr. Michaud.

company. The White House adheres strictly to a policy of
not permitting any use of the President's name, likeness,
photograph, or signature in any way that suggests or could

enterprise. Your use of the letter and the President's name
in the advertising text clearly contravenes this policy,
conveying the false impression that the President is assoc-
iated with or has otherwise endorsed your company.
Our concerns are not merely hypothetical. The White House
has received complaints about Digistat, and inquiries as to
why the President appears to have endorsed it.
I must advise you to cease immediately any use of the letter
from the President or the President's name in commercial
promotions for your company. Please advise this office of
the steps you have taken to comply with this letter.

9th. April 1985
I recently purchased an American Digistat Energy Saving System
solely because the US President featured prominently in the
advertising literature. (copy enclosed).
"The service must be good if the President of the United States
appears to be endorsing it", I reasoned.
You can imagine my surprise, therefore, at the absolute amateu-
rish farce we had to witness during the system's installation, a
humourous, but never-the-less factual account of which is en-
closed.
As you can see, we were subjected to considerable inconvenience
and danger, which prompted us to seek some explanation and compe-
nsation from Digistat for this traumatic experience.
Surprisingly, the US head office has not seen fit to reply to my
letter, far less offer an explanation for the installation sham-
bles.
I can only assume that they see nothing wrong with the service,
otherwise they would offer at the very least, profuse and embar-
rassed apologies.
Coming, finally, to the point, Mr. President, it is unlikely that
my experience is an isolated one. You may feel as I do that in
view of Digistat's cavalier attitude towards their clients, you
may wish to dissociate yourself from their advertising litera-
ture, since this liaison is unlikely to be enhancing the Preside-
ntial image.
In addition, I would be extremely grateful if your office would
use it's influence to elicit a reply from Digistat on my behalf,
since they have chosen to ignore my correspondence.
In conclusion, I genuinely hope that you will find time to reply
to this plea for help, to restore our faith in American courtesy.

DIGISTAT ENERGY SAVING SYSTEM
Dear Sir,
I have just had a Digistat Energy Saving System installed, and I
relate the following saga for your attention.
Thursday 31/01/85
18.00 Engineer finally arrives.
20.00 Engineer feels he has unravelled the mysteries of our wiring
system, and begins re-wiring.
20.15 Engineer complains that the system has gone dead.
20.30 Investigating.
20.45 Main domestic fuse-box examined. - seems OK.
21.00 Main domestic fuse-box re-examined, and blown fuse replaced.
21.05 Engineer wires up the Hot Water Programmer, and pronounces it
dead.
21.10 Engineer replaces its blown fuse by ingeniously wrapping wire
around the terminals.
21.15 Engineer wires up the hot water tank sensor probe, without
incident. I replaced the ceiling in the airing cabinet, and tidied the
excess wires later.
21.30 Engineer wires up the thermostat box in the living room, where
my invalid wife is resting on the sofa.
21.45 Back to the kitchen, where the engineer activates the
Programmer, for a test run.
21.45.01 A SHARP EXPLOSION, AND A SHRIEK FROM THE WIFE EMANATES FROM
THE LIVING ROOM.
21.45.02 Blue smoke billows from the thermostat, while fragments of
hot transistor are whizzing round the room.
21.45.03 Engineer pronounces thermostat box faulty.
22.00 Engineer proclaims that there is little else he can do that
evening.
I breathe a sigh of relief.
22.05 Engineer promises to return next day at 17.00 sharp, with a new
thermostat programmer.
I count my blessings that although its mid-winter, and we have
been left with no heating, I have known it to be colder outside.
Friday 01/02/85
08.00 Woke up with frozen ears, and realised it was not just a bad
dream.
08.30 Went to work to thaw out.
17.00 Back home, still freezing and cursing Digistat.
No sign of the engineer.
17.30 Still no sign of the engineer. Took off my mittens, and 'phoned
the sales manager, who promised to investigate.
17.45 Sales manager 'phones back. Engineer is supposedly stuck in
Glasgow with a faulty car. (Perhaps he does his own maintenance, I
mused.)
No-one would be able to come out that night, mid-winter or not.
But definitely to-morrow.
17.50 Can't help wondering why the engineer did not 'phone to say he
could not come, knowing we were without heat. With his luck, perhaps
the 'phone blew a fuse or exploded, when he put the money in.
18.00 Wife and I had a shower in the cold, and went out visiting, to
keep warm.
Saturday 02.02.85
03.30 Wife and I returned suitably fortified against the chill, and
went to bed in a foul mood, making a mental note to cancel everything
in the morning.
09.30 Sales manager 'phones to say that a different engineer would
arrive at 10.00.
Got up to a cheerless house.
10.30 Wondered where the engineer had got to, and wished I had been a
priority case.
10.50 Engineer arrived with a new thermostat programmer.
The adrenalin is beginning to flow in anticipation.
10.55 Engineer fits new unit to wall, dismissing my protestations that
it was probably faulty wiring that exploded the first unit, with a
10.55.05 Wife beats a hasty retreat to the other end of the house.
11.00 Engineer actuates the water programmer in the kitchen.
11.00.01 SHARP EXPLOSION AND BLUE SMOKE EMANATES FROM THE LIVING ROOM.
A strong sensation of deja vu swims through my brain.
I seek out the wife, and assure her it is all over.
11.01 Engineer concedes that the chances of coming across two faulty
units in succession is remote, and proceeds to investigate his
colleague's wiring.
11.15 Engineer declares that the thermostat unit was wired with 240
volts instead of 24 volts) ie for two days, live terminals at mains
voltage were hanging exposed out the wall, at face level
Perhaps the theory was to deter snoopers from inspecting the wiring
too closely.
11.40 The sales manager arrives with two more thermostat boxes.
I was relieved to note that we now had a spare.
11.45 Engineer breaks domestic junction box in two, and leaves it
hanging at a jaunty angle on the wall, suspended only by the
electrical cables, doubtless to have it in harmony with the rest of
the wiring.
12.00 The heating appears to be working, and the wife is gently
encouraged to inspect the monitor units, re-assuring her patiently
that all was well.
12.10 The engineer thanks me for the use of my tools, and departs.
12.15 My wife and I have a coffee, and await the Candid Camera team to
make their entrance. Amazingly they never came
Still, there is always the Esther Rantzen show.
In the event that you have found this factual narrative amusing but
educational, in that there are lessons to be learned, you may wish to
use it as part of your engineers' training schedule from now on to
serve as an illustration of how not to intsall DIGISTAT.
