Draft Letter
You have asked for our views on a draft letter responding to
a telegram on the Demjanjuk case. I have no objection to
the first paragraph. As you state, the White House must
avoid comment on pending Department of Justice prosecutions.
With the first sentence of the second paragraph, however,
you are buying a pig in a poke. The East European ethnic
community has expressed a broad range of concerns about the
Office of Special Investigations, and Mr. Buchanan should
not state that he shares them all. A minor point: "alleged"
is misused in this context. We do not seek to uncover and
prosecute "alleged" war criminals; we seek to uncover and
prosecute war criminals. The individuals targeted become
alleged war criminals.
The second sentence of the second paragraph strikes me as
committing to too specific a course of action and perhaps
raising false hopes of change in OSI on the part of the East
European ethnic community. Your correspondent will soon
want to know what recommendations were made and whether they
will be followed. If the Administration cannot support any
such recommendations, you will be in the position of reveal-
ing internal disagreement.
The following substitute second paragraph avoids these
problems:
With respect to the more general issues
surrounding the U.S. Government effort
to uncover and prosecute war criminals,
Mr. Buchanan has asked me and other
members of his staff to review the
complaints and comments we have
received from ethnic and civic groups.
You may be assured that we will give
every appropriate consideration to your

Dear Friends:
Pat Buchanan has asked me to reply to your telegram of April 25,
1985 regarding the case of John Demjanjuk and the general con-
cerns of the East European-American community and other citizens
regarding the mandate of the Office of Special Investigations.
Because of Mr. Buchanan's current position on the White House
staff, we have been advised that it would be inappropriate for
him or any member of his staff to comment on the specific case of
Mr. Demjanjuk.
As regards the general issue of U.S. government efforts to
uncover and prosecute alleged war criminals, you should be aware
that Mr. Buchanan continues to share the concerns of citizens
such as yourself. He has asked me and other members of his staff
to undertake a review of the complaints and comments of interest-
ed ethnic and civic groups and prepare appropriate recommenda-
tions.

against them in litigation and seek a more favorable State-
ment to overcome this hurdle. The request is passed along

Thank you for your letters to the President and First Lady
concerning the Sixteenth Amendment to the United States
Constitution. In your letters you questioned whether that
amendment had been duly ratified.
The Secretary of State issued a proclamation declaring that
the amendment had been ratified on February 25, 1913. The
dates of ratification by the various states may be found in
the historical note following the text of the amendment in
the United States Code Annotated. I have enclosed a copy of
the pertinent page for your information. Numerous court
decisions over the years have recognized the validity of the
Sixteenth Amendment.

Dear First Lady:
I recently sent an important letter to your husband asking
about how he wanted me to handle a situation--he didn't answer.
Maybe he didn't receive the letter. However, I need an answer
so I shall explain again.
As I am the President of the United Taxpayers of New York
State, I am bombarded with materials and questions. One evening
a tape by "Red" Beckman was brought to the meeting. In this tape,
the people were told that the Sixteenth Amendment makes the law
that never was. "Red" explained that he and his friend had been
to every state in the Union and studied the passage of the sixteenth.
The result was that only four states had passed it legally.
My people became very excited. I am at a loss for an answer.
I managed this situation for this year. The question remains--
What shall I do in the Future?
Sorry to have to bother you. This is a serious situation
and deserves the President's answer.

to contact you. Mrs. Lonero was a teacher of Dr. Jeffrey R. MacDonald who
was convicted in 1970 for slayings of his pregnant wife* and two young
daughters. You are probably familiar with the film "FATAL VISION" con-
cerning this case.
Hedy Lonero knows MacDonald to be innocent as a former teacher of his.
MacDonald maintains that 4 drug crazed intruders killed his family and also
attacked him. He is now seeking an appeal in the 4th U.S. Court of Appeals
in Richmond, Virginia. Could you please support his efforts for a fair,

Major Arthur D. Nicholson for posthumous promotion to
lieutenant colonel, and finds no objection to it from a
legal perspective. Detailed statutory procedures do exist
for normal promotions, but the President retains authority
under the Constitution to submit nominations outside those
procedures. Precedent for the exercise of this authority
may be found in the routine promotion of astronauts after
their space flights. In those cases, the constitutional

Anglo-American Successor Generation Program
David Chew has been nominated as a potential participant in
the Anglo-American Successor Generation program. The
program, sponsored by the Royal Institute of International
Affairs and Johns Hopkins University, and funded by the J.
Howard Pew Freedom Trust, is designed to promote dialogue
between the next generation of British and American leaders.
Chew is one of 100 nominees; 24 nominees will be selected to
go to England October 23-27, 1985, for the program.
I see no reason to object to Chew's potential participation
in this program. A strong case could be made that he has
been invited in his private rather than official capacity,
since the selection committee looks to overall accomplish-
ments of the individual rather than specific government
positions. In any event, the J. Howard Pew Freedom Trust,
which funds the program, is a 501 (c) (3) organization.
Accordingly, even if Chew were considered to be participat-
ing in his official capacity, he could accept reimbursement
for expenses.

at The Johns Hopkins University School of Advanced International
Studies has selected you as a potential participant in a series
of Anglo-American conferences for the "successor generation.
These annual conferences are being sponsored with Britain's
Royal Institute of International Affairs to promote a more
meaningful dialogue between those who will become international
leaders in the United States and the United Kingdom. The
program is supported by the J. Howard Pew Freedom Trust, and
operates with the guidance of a steering committee which includes
Milton Eisenhower, Senators Mathias and Sarbanes, Ambassador
Kingman Brewster, and others.
The program is an innovative effort designed to restore
dialogue between British and American leaders. The partic-
ipants--American and British, aged 28 to 40--are people con-
sidered most likely to succeed to positions of authority in their
countries. The conferences establish a forum for high-level
discussion of major themes in the political, economic, foreign
policy and social arenas. The long-term result anticipated is
the creation of a pool of talented leaders who have a deeper
understanding of the views and aspirations of their counterparts
and who can be counted on to manage the Anglo-American part-
nership with heightened sensitivity and competence.
The Committee is one of 21 regional committees that have
reviewed the accomplishments of many possible nominees throughout
the nation. You are regarded by leaders in this country as
representing the new generation of men and women who will manage

nominees have been designated nationwide; you are drawn from a

in management or the application of technology, or demonstrated
exceptional ability to influence contemporary issues. Those
selected will be invited to meet with their British counterparts
in Oxfordshire, October 23 to 27, 1985.

This is of course a for-profit, commercial activity, and the
President should not participate in it. Exceptions to the
general policy against such participation have been made
(tossing the coin for the Super Bowl telecast, the "This is
Your Life" participation discussed at this morning's staff
meeting), but I see no reason for an exception in this case.
